I can not find the thread by Spike any longer, regarding the FAQ but anyhow. I just discussed yetserday the patent issue with some webmasters in Germany and during our discussion I remembered that the IMPAI is looking for some BBS files to proof that the delivering of compressed video and/or audio were already in place before 1991.

In Germany we had a different system in paralel to the old BBS. This System, BTX were driven by the German Telekom and it had allowed downloads, movies, chat's etc. Maybe this will be also a good point to search for while fighting this patent.
A system like the BTX were and is also available in France, called Minitel. As far as I know this system is still running and is driven by the France Telecom.

Prior art of digitized audio or video files needs to be be prior to 1990 in order to be a possible candidate to invalidate the patent.

Also, proof that the file was available and distributed prior to 1990 is needed (ie. BBS/FTP logs, testimony to verify the validity, etc).

I do not think this is a wise way of dealing with this and I do not recommend it to anyone that cares about his/her business.

The consequences of such actions are not pleasant and if a person thinks that a simple domain change is going to make a difference then you are totally mistaken.

I am not an attorney and this is just my opinion, but I am pretty sure that the individuals that are responsible for doing what Lace's site did could be held personally liable for such actions. In my mind, actions like that could be construed as willful infringement. If that is the case, it could mean huge fines PLUS other damages.

We can show why we do not validate the patent. We can invalidate the patent. We can license. We cannot run and play hide and seek because Acacia is not playing games and this is a serious LEGAL matter.

Webmasters need to get informed over these patent abuse cases. An AVN poll shows 80% don't care or don't know about these issues. This is especially true if you get one of those "information packets" that describes your infringement upon their patents.
