                                  Thats absurd. A most likely first time offender for a property crime, 18 years old. Huge fines, slap on the wrist, and a nice job at some security firm when he is off probation.

                                  If not, then he has a shitty lawyer.

                                  He didnt write the worm, he just coded a variant. He is a nobody.

                                  AND even if he does get some time, it will be at a minimum security day camp. Like they would throw this kid in with murderers and rapists. You people have a very skewed view of the prison system.

First he is looking at up to 10 years as charged under federal guidelines. There is less discretion under the federal guidelines for downward departures due to factors such as age and no prior record. Judges who are doing downward departures right now on the federal level are being harassed in a major way by the DOJ.

                                                                                      Secondly, and more important, there will be alot of pressure to make him serve time to send the message that you WILL go to prison if you do this, even if your 18 and a no record computer geek loser like this guy. Hell, this guys profile is exactly who you would think would be the ones doing kiddie hacking and virus making. If you cant penalize this guy with jail time, arguably you are only encouraging the great bulk of losers like this guy. Non collectible fines and house arrest only send the message that there were no real sanctions.

                                                                                      This reminds me in a way what the former CEO of Vanguard funds said about all the corporate mischief that happened in the last couple of years. Bogle was quoted as saying the first time an executive gets a 10 or 15 year sentence to a real prison, that will be the end of all the majority of these corporate misdeeds. Nothing sends the message clearer than hard time in a real prison.

These viruses and worms used to just be a nuisance, they are becoming a real threat. My wife works at a medical company - she's been trying to get their networks locked down but there are always a few idiots who think nothing will happen.

                                                                                                                  They were virtually shut down for several days because of this and the sobig fuck.

                                                                                                                  This kid will get time - not necessarily because he really deserves it (although I think he does), but because they have to make an example of someone, and he's the one they caught.

                                                                                                                  The likelihood that the original version was written in the US is small. So that person may well be out of reach. But fat boy is here, they have the evidence, and he is in big trouble whether he knows it or not. Not only that, but from what I understand he was talking to his own registered site (that's how they caught him) so the fuckwad isn't all that bright - no high paying security job for twinkie boy

                                                                                                                      I read more into this afterwards and this guys role was pretty minimal. I would agree now that he wont get a ten year term. 10 years is the absolute top end and would have been reserved for the real authors of msblaster. Unless there is alot more to be revealed by the feds to show his role resulted in tremendous amount of damage, what i'm getting out of this he only renamed the virus file and maybe mucked with it a little and then sent it back out, bragging to someone else while he did it. He sounds more stupid than devious. My guess is this will be resolved with a guilty plea, 6-12 months prison with 5 years paper, a sizable fine and possibly a felony conviction. One thing is for certain, his life just went into the shitter and it will be many years before he will no longer feel like hes under Big Brother's thumb.

                                                                                                                      I never once said the Feds message was effective, that it actually worked. I did criminal defense for 5 years-- Ive seen the results of get tough on crime measures, and they rarely result in anything more than a boom time for people who work in prison construction and corrections. The increase in Fed minimum mandatory sentence for drugs in the last 5 years has quadrupled the number of people incarcerated, and its not like smoking pot or selling crack is in danger of going under any time soon. Drugs have been criminalized for a long time though, and people--even complete moron 18 yr olds, understand that you go to prison for selling coke to minors. Im not convinced that right now all the kiddie hackers take in the scope of their activities and equate prison with them. Thats what a fatass sentence or two will do, it will open the eyes of a percentage of the recreational hackers who do it for kicks. I dont think it will stop the criminal virus activity where keylogging and access to passwords, credit card info etc are the goals, but it will give pause to some of the idiots doing these things to impress their IRC buddies on saturday night.

If people are going to working online or running major corporations they should be at least a bit smart and know what they are working with/how to prevent yourself from getting owned from a virus or hacker. Sadly though its more off the people who know not a single thing about the internet nor computers that are having all the problems.

Then in another act of sheer stupidity, he made a tiny modification in the virus that he copied, and had it send a message to his website, t33kid.com. Which, BTW, was registered in HIS NAME and had his address and phone number in the registry. Yeah, we're talking about a real rocket scientist here!

                                                                                                                                                                      The creator of the Melissa virus has been jailed for 20 months and forced to pay a $5,000 fine.

                                                                                                                                                                      The judge in the US case said David Smith, who wrote the destructive virus that swept around the world in April 1999, would have faced a stiffer sentence if he had not helped the US government in preventing future virus attacks.

                                                                                                                                                                      The Melissa virus was the first to do major damage to computer systems worldwide.

                                                                                                                                                                      Smith's $5,000 fine is insignificant compared to the damage Melissa caused. The prosecution and defence in the case both admitted the damage caused by the virus was in excess of $80m, but some estimates put the damage at nearer $1bn.

                                                                                                                                                                      Entitled "important message", Melissa disguised itself as an email from a friend. A blueprint for many of the mass-mailing viruses that followed, when opened it copied itself to 50 people in the victim's address book.

                                                                                                                                                                      Smith was also ordered to stay away from computer networks or the internet for the foreseeable future.
                                                                                                                                                                      While I seriously believe that this fucktard, assclown, shitlicking dickwad should have gotten the max sentence, plea bargains prevail today. What I find notable is that he's forbidden from accessing computer networks - but what the fuck does "the foreseeable future" mean?

That's fucking skill man.

He'll be owing every dime he'll ever make to businesses his farting around damaged.
