    Acacia has a new trick

Apparantly Acacia is now serving registrars of domains they feel are infringing upon and the registrar is locking domains.

It happened yesterday to a customer of ours. Nothing he can do about now....all traffic is gone from the site.

Not sure if this has been discussed here but though i would let you know. Its going to get messy.

        Which registrar?

I doubt the OpenSRS would go for such a thing...

            Can they do that???

I think that they would have to prove that the person( site ) wasinviolation of their patent first. They have not done that yet! at least not that I know of.

            That is like thought crime..

You think about kicking the ass of the guy in traffic and you get arrested for it. UNtil it has been proven, they should not be able to do that. I hope that the registrar checked with an attorney first!!!

I see registrars about to get served in both directions in that case.

I would think that no Registrar would deny a property right ( Thank you Gary Kreman) without a court order. I doubt any court would issue such an order without a hearing for an injunction.

Godaddy will delete any domain at the drop of a hat
They also do some shadey shit like releasing domains to domain brokers before they become available to the public

A year or two back it happened to me, godaddy sold my active domains to a domain broker.

If I remember, he lost by default by a no-show for the first court hearing. Ignoring Acacia is apparently not the way to go...

I don't see how that would be in Acacia's best interest unless the site is one of the 5 that didn't show up for the first court date. If they start locking domains, they won't get there money. Either way, they won't get the money. That would be a dumb thing to do unless they have already taken this person to court.

Ignoring Acacia certainly isnt' going to make them go away. I believe the only domains that were shut down were those who failed to respond and got prelim injunctions.

I don't think any registrar is going to shut down a domain because "acacia said so"
If acacia shows the registrar a court order, then that's a different story.

Yes. And I can see it coming to the hosting side of things too.. It's similar to issuing DMCA violations, and I would think that the hosts could be held liable as well in cases where the websites in question did not respond to Acacia's legal overtures. Just as a hosting company can be held responsible for hosting stolen content (or "illegal use" of technology) , because in the eyes of the law, the two situations are essentially the same.

as shitty as it is, if the guy was a no show to his court case, Acacia can get away with this... However if they did it out of the blue to someone that hadn't been served ... then it would be another story..

I belive Acacia will end up pissing off the right people and this shit will get finished.. too bad they are picking on the little guys in an atempt to win some cases.

Not exactly a new tactic as such then. Simply a case of people being stupid enough to believe that burrying your head in the sand works and finding out it doesn't.
                                                        Ignorance is never bliss.
