                            It's not libel unless he is defaming an innocent Easton and Easton's lawyers can prove so in a court of law (or compel Brad to settle out of court). The burden of proof is on the accuser to prove defamation and libel, not the accused to prove jack shit.

                            So if Easton wants to win a defamation suit, all he has to do is prove that he didn't do coke or have someone do coke off his cock at the porn convention and that Brad made it up to slander him.

                            I'm gonna have to go ahead and say that Brad is pretty safe here.

                                            The issue wouldn't be specifically if someone did coke off his cock. That has nothing to do with the defamation and libel. The issue is simply whether or not Easton does coke. From what I have heard and read, the witness list to that point would be pretty long.

                                            Technically I suppose that fubar could sue for C.I. Although, proving damages would be difficult, I don't see any. I also don't think that they would have much time to spend on the C.I. case while they defend themselves from the countless misappropriation suits filed against them by all the people in the pictures on their website that never gave consent to be published. Ok...kind of a run on sentence, but I believe it makes my point.

Yes, he could probably sue Brad for infringement. What would he collect? Little to nothing. Damages in this case are minimal, if even existent at all. In addition, FUBAR pics are hotlinked and used all the time, has he sued all of those people as well?

                                                                                                        Once he is done suing Brad for CI, he can expect that he may be sued by every person in every picture on his site for misappropriation of likeness. I see mega damages there. Private citizens, attending private parties, having their image and likeness published on a porn webmaster board. Believe it or not, there are a lot of people in our business who don't tell others what they do for a living.
