            We never found out any BBS numbers out as far as LA. We did Rusty N Edies in hmmm, 95 I think it was and a penthouse BBS. Mostly we stayed local. We had 2 full adult BBS's and about 3 partially adult. (That I know of anyhow) Most were chat or game boards. Our County Mental Health Association even had a chatboard. lol Met my old man on the biggest adult one. Way too much fun back then. Most had video and audio but you had to D/L it to play at home.

                  "Here's the abstract from patent #5,132,992 -- their main patent. :

                  A system of distributing video and/or audio information employs digital signal processing to achieve high rates of data compression. The compressed and encoded audio and/or video information is sent over standard telephone, cable or satellite broadcast channels to a receiver specified by a subscriber of the service, preferably in less than real time, for later playback and optional recording on standard audio and/or video tape. "

                  it seems to me that if our objective is "prior art" we can go back further than the bbs days of the 1980s to the 1960s when at&t introduced the picture phone which was presented at the worlds fair in 1967. as an real old fart i remember this shit. it was used to transfer "moving pictures" for rebroadcast or direct viewing as in a video conference. it did not make much of an impact and was pretty much discontinured in the 1970s.

                    .GL is your best bet I think -- it was the first popular format that hit the BBS scene through PC's... and there were definitely pornos in .GL format. I remember a girl fucking a banana and a soda can... All these files are long gone, but you can contact the company that did .GL format -- they are still in biz...

                        This would seem to be a key phrase: "for later playback and optional recording on standard audio and/or video tape." I can't see how this would apply to the internet at all. I haven't read the rest of their so-called patents lately but this part of it would seem to take a lot of wind out of their sails.

                          to everyone trying to find something that EXACTLY fits the abstract on the patents... We do not have to do this!

                          The point of the whole thing is this:

                          People on our Sites do 3 things involved with video:
                          1) Download video files for later viewing
                          2) View streaming video files
                          3) View live Pictures coming from webcams

                          As long as we can find prior art that fits those 3 things, we can do those 3 things. Acacia can not add any CLAIM to their patent that would let them charge us for doing this if it was done before their patent was issued.

                          The .GL format, if it really was around before 1990 and if we can PROVE it was very likely invalidates 1)

                          2) I am not sure of.

                          The AT&T Picturephone should invalidate 3), IF acacia even HAS CLAIMS for those. They do mention live one-on-one video in their patent on the very end...

                            Berman said that webcams are not covered but that they were going to try to add that to their existing patents. Something like that anyway.

                              We ran large adult bbs's in the late 80's and 90's. Like Lee Noga and others we were quite large in the adult cdrom business.

                              I remember, gifs, dl's, gl's, etc.

                              There were movies back then, mostly crappy ones, but they got downloaded.

                                    Both Java and VRML existed back then?

                                    In particular VRML - surely they were using some type of compression streaming technology prior to the patent.

                                    And did Java incorporate existing compression technology (pkzip) to send graphics ? Would a "slide show of photographs" where images are changed ever two seconds, shown in real time as intended by the trasmitter - not be against the patent as well? Is not "real time" - "as the artist intended"?

                                                    Glite, it says "A SYSTEM" Not THE SYSTEM, and this is just an abstract, its brief and has a broad description Now to find out the "A System" consists of, you have to go read the claims at the bottom. But I think this is where Acacia is trying to get over on people, they want people to read the abstract and think its for all video, hell, maybe they actually believe its for all streaming video. and they dont understand the claims themselves.

                                                    now the problem with finding prior art will be that it probably wont fall under the patent, the patent is specific, there is a specific process, but when acacia points out why it dont apply to their patent, it will be the same reason why their patent dont apply to most all of us.

                                                        Macs did have modems in 91, called the Centris 660av, which was as you said FAC, a GeoPort, the name given to their serial port enhanced with Direct Memory Access. It meant that you could run at a blistering 2Mbps, as opposed to 230.4kbps with a typical serial.

                                                        From there came the GeoPort Telecom Adapter that worked as a 9600bps modem, fax and speakerphone. Through the years the software was updated to run at 14.4 and 28.8, with no hardware changes.. hence the forward optimism of Mac developers.

                                                        It was all scrapped when the Performa and PowerMac came out, and replaced with the GeoPort Express Modem.

                                                          I can't seem to remember the name of one of the biggest bbs's / adult download systems. They were from the portland area, Lake Oswego, and had hundreds of lines for a few years. The sold everything by how many megs you downloaded. 800#'s galore. Mabey something fantasy bbs, etc. Were in all the mags in the 80's, 90's, etc. Also had a domain like 3wi or 3mi.com or something like that. They made there own videos, etc.

                                                          Can anyone remember this? Lee?

Here's a better link than before - http://bbslist.textfiles.com/usbbs.html Now the question might be, how many of those sysops are still within their area code and could be found at www.anywho.com? Because if it's downloading vids back through that time, they would be the people that would be more than able to show what what was back then.

                                                                  One good sysop manual that describes how to set up a directory for video selections or what's needed for binary file dl or such could be considered published prior art.

                                                                          ACACIA's broadly written (and patented) application is truly a serious concern for all of the internet community.

                                                                          ACACIA's patent is nicely summarized by them on this page:

                                                                          Digging back into the BBS days, we could find prior art by looking for the following:

                                                                          Audio or Video content (this covers the digitized part).

                                                                          Compression -packaged in a player format like GL, or self-running .EXE, or archived with like ARC, PAK, LZH, etc (this covers the compression part)

                                                                          BBS (this covers the storage part)

                                                                          Phone lines (this covers the transmission part)

                                                                          GL Player or self-running EXE that has stop/play button (this covers Receiving and Playback)


                                                                          GIF images are not prior art, has to be digitized content. I am currently doing research to find prior art as well as documenting this issue for an upcoming article on xbiz.com

                                                                          I wanted to put my thoughts to the board, so that others can start to look for files with the above criteria.

                                                                          You can read the patent abstract on their site. The basis of the patent is the idea that a person would want to watch some video/audio clip faster than having to get the video tape. Using digital transmission medium of satellite or phone lines, the clip could be transported to another location to be watched. It makes no claim about streaming component, that's just a technological advance that software companies came up with. Their patent covers the viewing of a clip on a PC that was received from a remote location digitally.

                                                                          The persons who came up with the patent were probably old school BBS'ers like me, who saw what was going on in the underground scene, and took those ideas and patented them in the mainstream, before the web explosion. All of this "new" web technology is just old technology with a new face (ie. web browser = gopher + ftp + WAIS + GUI

                                                                          The ACACIA goons are most likely reading the various threads around on all message boards, and will most likely try to further define their patent by applying for more patents that more closely resemble today's technology. While this gives them further protection and definition of the patent, it can all be undermined if the underpinnings of the patent were able to be knocked down.

                                                                          I am doing me own research to dig back to the BBS SYSOP's, to try to find actual files that contain a copyright date within the file as well as company names that produced the data, so that they could be tracked down.


                                                                          If we all know what we are looking for, then it will be easier to find than a "needle in a haystack". Problem is, stuff that existed prior to 1991 is most likely in digital heaven, or in some museum.

                                                                          Let's find the prior art and end this!

                                                                              don't know if this helps, I found an old CD with a bunch of gif's on it, with BBS's and some phone numbers. A lot of the gif's are dated in the 1980's. Also the person saling the CD with mailing address in Altamonte Springs, FL. Don't know if I should post the address and Phone numbers so I won't.

                                                                                    I noticed it with a mixture of amusement and pity. There seems to be a number of well-intentioned people whose unsophisticated approach to a complex problem makes for an almost cartoonish "The Acme Patent Buster!" solution.

                                                                                    Too many of us take the lazy approach of reading just the abstract of the patent and then deciding that because something seems to have existed before that time that is described there, it must be "prior art".

                                                                                    It's within the "Claims" of a patent where the invention is defined and its scope is determined. And the scope of an invention is very important because that's what's used in determining whether an infringement by another exists. Until you're familiar with the claims of an invention, you're not going to be able to recognize what the prior art is that may affect them, either directly or by limiting their scope as written.

                                                                                    Unfortuantely, the claims are written in a very strange and esoteric way. Their construction is convoluted and words have specific significance to them that they don't usually have in their ordinary usage or even in other legal documents. If someone is interested in how to read and interpret claims, then I'd suggest they get a copy of Patent It Yourself by Nolo Press and study Chapter 9.

The footage is old, but it could also be an "artistic" piece that was actually recent footage. There are video clips of adult content that go way back to the silent movie days. Those aren't considered prior art just because someone digitized them.

                                                                                              i believe the issue of "compression" is more of a practical one that since there is a need to transmit the file to another location, that the smaller the file size, the faster the transfer.

                                                                                              i think the author of the patent or the technie that advised them of this idea, probably told them that if they used an archiving format like ARC, PAK, LZH, etc, that the file size could be smaller, therefore it could be transmitted faster. Also, borrowing from the ZMODEM protocol, where data was automatically compressed to make transfers smaller.

                                                                                              unfortunately, ZMODEM is not the "prior art". it would have been cited as an "off the shelf" technology that could be used to implement ACACIA';s patent (or whoever the original author was before they bought the patent).

                                                                                              When/if you read the patent, they were being forward thinking, patterning the idea around a VCR, but having everything digital.

                                                                                              Video Tape becomes a digitized file

                                                                                              VCR becomes software that does playback on a PC

                                                                                              Taking physcial tape from store/office to home became downloading the digitized file via satellite or modem.

                                                                                              To the patent office reviewers back in 1991, they might have thought this was a unique idea, not knowing that the patent application stole its idea from the BBS (underground) world that was already using digitized files (ie. adult video clips).

                                                                                              All new technology is utilized by the adult industry, from the silent film days, to the telephone, to the internet.... So what better place to find the prior art, then from within the dusty archives of the adult industry.

                                                                                              When ACACIA gets overturned by the prior art, it will have been their "dirty little secret" that they thought they could get away with stealing ideas and methods from adult BBS providers, in thinking that mainstream wouldn't ever catch wind of their "original idea".

                                                                                                      Good point.. while i am doing my own research, the end result of whatever i uncover will need to go to someone's attorney, since i am not named in a suit and i don't feel like knocking on ACACIA's door asking them send me a C&D and sue me for the use of streaming audio just so i can say "ha! in your face, you suck, your patent is voided, game over, looooooser". Though, in typing that out and having it echo in my head, it would be a rewarding thing to be able to say if i did find the prior art evidence.

                                                                                                      BTW, the above text has been copyrighted and trademarked with filings in both the US and international agencies and a patent filed for a business method of responding to false claims with a retort that closes the process with a self-rewarding glow of achievement.


                                                                                                      I think that Free Adult Content and Home Grown Video are leading the charge, as well as the www.IMPAI.ORG website. So that's where i would probably turn to give support.
