After we eliminate all the bizzle dizzle bullshit, it should be a very good show. But D$, don't give us a blow-job...whether you make money from your radio show is insignifcant to your listeners, but you get bunches of PUBLICITY, and we all know that you and KB are publicity whores! Nothing wrong with that, but you are getting a whole lot of attention by interviewing Acacia.
You can do it without KB's Gary Kremen impersonations. Tell KB to pay Brad Shaw the money he owes him, and to come back another day.
Take the questions in advance, and don't try to *wing it* on the radio. If you want to be taken seriously for once, do it right and treat your audience and guests with respect by being prepared.

I've already stated a bunch of times in this board that we used to be a non serious show, but due to the serious issues in this industry, we've changed. I don't think anyone wants to hear a KB impression or us talkin' shit and having fun. That would be in horrible taste considering we're doing a 2 hour special regarding Acacia. So, I agree 100% with you.
The publicity whore thing seems like you have a little hater inside you, but I can get past that. I will say I am a marketing person and publicity = promotion which equals marketing.
And wouldn't I want to market this show? Do I really benefit personally from this? Not really. I do have intregrity. My industry is hurting right now and I have a live radio show which can help address the issues concerning all of us. Shouldn't I do my best to help?
I do however appreciate that you care enough to make a post like that. I will agree, I did usually wing my shows because I did them for fun. These shows however are very serious. KB is known for making his bucks by doing PR & Publicity work although he makes it seem like it is a 24 hour a day lifestyle and not a job! Great.
Are you telling me that if nobody paid attention to any of the above D$ items, that you would continue to do them? Hell no! You need the publicity to get sponsors and to attract the attention of people like myself so we will listen to your radio shows and attend your Players Ball parties.

my prediction will be one of two things.
1. Berman wont be able to stand the heat of the questions asked him and will say something like 'this is a waste of my time and wont be treated in this disprespectful manner' and hangs up.
or
2. Every single answer to every question will just be the same exact spin worded in a different way "bla bla we own legitimate patents and are only seek a small % and not looking to put companies out of business. It is in your best interest to pay us now rather than having to go back 6 years bla bla"
Most likely it will be #2. Either way a waste of time, but I suppose it will be fun to watch him squirm when really good tough questions are asked.
These guys are idiot douchebags. They probably think by going on the show they are going to convince people they are credible and great guys.

I'd like to know the EXACT extent of what acacia wants to go after.
I understand they are going after anyone who uses streaming media.
are they going after the manufactorers of the programs that people use to encode video?
what about plug in content? do they hit BOTH ends of this - the provider and the user? that doesnt' seem right or legal...........
what about LINKING to content?
what about advertising someone else's url?
what abotu THINKING about using streaming content?
what about if someoneone down the street uses streaming content and is on the same dialup network as you?
and so on - there is no end..........
The other thing that i'm not keen about and makes me thing there is something utterly wrong about this is the gross revenue idea. Many companies only have a small percentage of their operation linked to some sort of motion pictures yet my understanding is acacia doesn't care and still wants a cut of the entire gross revenue, including that unrealted to their bogus patent.
I'm a little distrubed about how acacia ia going about this - they are attacking the end user - they SHOULD be going after the encoding programs and the manufacturors of such. it's kind of like the guy who invented turning signals on cars going after everyone who owns a car instead of the car manufacturors. Or better yet, only going after people who work as a currior who drive cars that have turning signals.
to be honest it smells like an extrosion scam to me.
my feeling is that if something like this is allowed to continue it degrades our entire legal system. I think just allowing acacia to persue this kind of extorsion scam should result in the removal of acacia's lawyers acredation and jail terms for the board of directors. it's a bad example of the problems that exist within the american corporate business structure today.

Sorry if I seemed a bit bitchy myself in my response. I've always had a gift in every industry I've been in of getting noticed, which dates back to the Alarm Industry days (security systems). This industry is fun with fun people, so appealing to a younger audience is easier then those past industries, as far as promotions. I will say this, you're right about the "if nobody paid attention would you do them" thing. If nobody paid attention, nobody would pay the bills. Some things in life you do for fun whether you get a ton of attention or just a little. Some radio shows had very small turn outs, almost nobody, but I still did them anyway because it's fun. The Players Ball I do for fun, but because people pay attention sponsors pay for the costs. In all honesty, I personally haven't maximized the expsoure into dollars for profit because of the fun part. Or I'm an idiot, not sure which prevails in that case.
Anyway, things are effecting everyone's business models lately. Visa, Acacia, governments, etc. I like to have fun when it's appropriate, but lately I should be more serious as a talk show host.

It'll be a long 2 hours. The case is in litagation... his answers will be exactly what the letter says, but he might take the time to rephrase or reframe his replies. But don't expect to learn much beyond that. It'd be poor business on his part to give anything away wouldn't you think?

I want people to know how this interview with Acacia came about. I called them after receiving my letter and left a message in their voice mail. A couple days later Robert returned my call. The main purpose of my call was to have them send me more information. Their claim in my mail was that they had contacted me several months ago, which they did not. As most of you should be in dealing with anything regarding patent infridgement, you should be compliant by having communication instead of blowing them off entirely.
In my conversation he was asking me the nature of my streaming. The letter was sent to the Players Ball, which has no streams. Although the Players Ball links to the D$ Show. Then we were discussing the D$ Show, about it being a webmaster site people go to for trade show videos and weekly live shows. He was interested in getting his message out to adult webmasters so he wanted to be a guest.
Basically, I wasn't after the "big interview". The "big interview" sort of fell on my lap. I told him we had IMPA on last week so this is good timing to have him on.Still Ballin'Comment

My hat is off to you for letting Acacia speak. We can't just pretend like they don't exist. Until the courts say otherwise Acacia has patents on processes we all use and whether we like it or not. The more we understand about the patents, the patent holder, and the terms of the licenses, the better we can weigh our options.
With all the rumors and supposed claims of Prior Art on some of the different individual processes outlined in the Acacia patents, and the complicated wording of the patents themselves, is it clear whether Acacia's patents are for the individual processes (which Prior Art supposedly may exist on), or is the patent only on the way those different individual processes are assembled to create a new process with the ability to do a specific task (encoding, compressing, transmission via specific mediums, uncompressing, unencoding, and displaying in a specific way)?
I was wondering if Prior Art in just one of the processes would be enough to invalidate the Acacia patent or would it require a Prior Art of all of the processes involved, in the same specific order etc. to invalidate it?

So its just giving them a forum to spew their scare tactics. This fellow will probably mention CE signing an agreement several times, as well as the going back 6 years thing. As well as the worthless default judgements over some companies.

Ask them if I should go ahead and file a law suite in my state, because I can not open my websites, out of fear of being served papers shortly after opening? So I am losing money right now , being I have paid for hosting, content and a lot of other stuff in reguards to adult sites which use their "claimed patents". I just hope the hosting supports everyone. Looks like lot's will be listening. No matter what happens with your feed during the show, it won't affect the archive version.
We're already making the higher bandwidth feeds in lower bandwidth, just out of caution. It might be fine, I'm just letting people know in advance just incase of any bad internet weather issues should happen.
Anyway, everyone's opinions and questions are greatly appreciated. I've had lot's of emails with great questions so far.

Acacia is building a record. Throughout the media, you have claimed that this is not a record of small win's to go for the bigger ones.
If this can be held as truth [(as it can legally since it has been published and not refuted in the mainstream media)], then there appears to be one other option left.
Does Acacia intend to build it's portfolio of people paying licensing fees for Acacia's benefit? Or are you simply building value so that when you do go talk to the big players, you can sell the company to them at inflated costs?
All I have read in the media says "We are also in talks with the big players ..." They do not specify what type of talks. But it would appear to me that you are inflating the value of your stock so that you can sell it all to a larger company. [personal note for GFY - these guys aren't here because they like their technology or care about the technology. They found a hole and are exploiting it. Their business and "Fun" is fucking around other people. THEIR BUSINESS IS MAKING MONEY, NOT PATENTS OR INVENTIONS. Whether they are able to admit that to themselves is none of our concern. The tools they have been given were given to them by the American Government and individual interpretations for many years of laws by many judges. So blame your forfathers for this stupidity.]
If this IS the case, then does Acacia intend to sell itself before someone challenges the legitemacy of their patent so that you don't have to "think" about it. Or must Accacia wait until any litigation that it is involved in, as initiated by Accacia or someone else, is complete?

I think this is an important point to ponder, everyone. If they just build the stock to $10/share and then sell to MS, we have an even bigger fight on our hands.
I liked the point made by someone that the fact they haven't enforced this patent for many years negates it. This would make sense for justice - but again, we are dealing with a system, not justice. On this note, does Acacia even have the ORIGINAL WORKING DEMONSTRATION of that which they are trying to patent? There are so many ways of not only interpreting what their patents say but of implementing it, that their high-level abstraction (that is what it is) of a patent is too foggy to claim any one specific part as theirs at all. (Since every part of that patent can be attributed to another patent.)
They are playing dirty pool. But they are doing it in conformance to the laws (I can only assume since people seem to be paying them.) This is how business works. Justice has nothing to do with Moral's or other BS like that. Morals are where the justice system becomes corrupt and OPINION enter's into things.
The U.S. runs it's own patent database. Thus making the U.S. an independant patent entity. Not having anything to do with International patents. Period. End of discussion.

As far as not letting them snake out of questions, I'm going to be fair no matter what my opinions are. If the answer if acceptable, I'll move on. If they can't comment, I can't do anything.
Just remember one thing, I've never been afraid to ask questions and neither should you. We'll give opportunity in the chat room to ask questions and take callers. I'm really hoping that we all learn from this and not take cheap shots just because we can.
My interview style for tomorrow will be as a journalist looking for answers based on the questions from the adult webmaster industry. I've been reading my emails and spending lot's of time making sure I fully understand the questions and it's points.

If you listened to last weeks archive with JMM from IMPA, he said it's not the mechanism, it's the process they're going after.
If the patent is upheld, to what extent will Acacia be able to offer the license? To the end user? To the maker of the players? To hosting companies? Or all of them?
My opinion is that the process is hosting and the hosts would have to pay a licensing fee and pass the costs along to their customer when using it.Still Ballin'Comment
