They are not going to lose any money. In fact they're going to make more. They want to beat the litigation to the punch.
If they denounce supersize (and make it look like their good-intentioned idea) before they are told that they have to, they get brownie points for looking concerned with their patrons health.
The people who order supersize will just order 2 large fries instead, which is more than one supersize, and costs more too.
Just because it isn't on the menu doesn't mean these hungry people arn't going to find a way to meet their calorie quota.
