    Acacia agrees to come on the D$ Show next week

    Our show yesterday was about the Acacia patent. I tried to contact them in advance to see if they'd be a guest on the show, but I didn't hear back from them until today.

    We had Spike & JMM on yesterday discussing their side, they answered lot's of great questions, awesome show, great turn out.

    It would be totally unfair to not have Acacia on the show to discuss their side.

    Usually our shows are on wednesdays, but I'm flying that day. I'll probably do the show on Tuesday @ 1:00 pacific / 4:00 eastern, as long as Dokk is cool with the day change. I'll know shortly.

    I'm letting everyone know this far in advance so you can get your questions ready. You can post specific questions in this thread and I'll try my best to read them while Robert Berman is on the phone, live.

    Everyone has opinions and views about whether they're right or wrong. Whether they'll lose in court or win. But as of now, they hold the patent.

    Thoughts? Comments? Questions?

                  I think its a waste of time. By having him on your basically saying the guy is credible and they have a case.

                  Thats like haveing steve cohen come on in 98 and explain why he has a right to every domain with 'sex' in it.

                                                                                                                              Streaming is just a basic protocol just like http.
                                                                                                                              Why haven't these guys said something about Windows Media's streaming technologies? Because they know they are wrong and they know they will get bashed so hard in court!

We are a webmaster radio show that provides news and events to other webmasters in our industry. It is our job to discuss the most important topics and events, whether they are good or bad. Look at the news, they have guests on all the time that are considered "bad" people, but its there job and duty to inform listeners and viewers with all the latest information.

                                                                                                                                                                  So, instead of complaining about it, use your brains, and come up with some good points and good questions. Both Darren and I got our papers, and neither one of us agree with the patents. I feel they are very unfair and not valid. But just because we don't agree doesn't mean they shouldn't come on our radio show.

                                                                                                                                                                  I'd be willing to bet anything that all those that are complaining about them being a guest, will be at our show listening to every word they have to say. This is the best way to really understand what they want and what to do about it.

                                                                                                                                                                  This will be everyone's opportunity to get information on a topic that has affected the entire planet. So don't miss the show, its going to be a big one.

                                                                                                                                                                      Surely if they participate in it, show their support of it via their participating, and allow the broadcast to continue without demanding that it be stopped because license fees had not been paid, then that would say *something* about how serious they are about this entire matter.
                                                                                                                                                                      I'm sure a judge would find it very interesting, indeed.

                                                                                                                                                                                  a) why they've been sitting on this patent for so long, and only now have decided to enforce it ? IIRC - lack of active enforcement of a patent from the get-go means they weren't that worried about any patent infringement.

                                                                                                                                                                                  b) ask them when they intent to go after Micro$erf and the rest of the "big boys" ? does this lack of action on their part against such large and "blatant" infringers on their claimed patent mean they really are just trying to shake down the "little guys".

                                                                                                                                                                                  c) depending on their response to b) ( IE - we don't care about Micro$erf or Real Player ), ask them how well they are prepared to defend themselves against every entity they've served papers on following Serges advice and filing racketering charges against them in their locale ?

                                                                                                                                                                                  d) now that micro$erf has annouced they will stand legally behind they're products and their use in court, is acacia ready to face micro$erf in court as most of the video products people use are probably derived/produced with micro$erf software ...
