Colorado law says that the media can not mention the name of an accuser in a rape case, only the accused. I think that's bullshit. If you are going to make an accusation that serious you have to stand behind it 100%. Either that or make a law that you can't mention the name of the accused until convicted.Originally posted by detoxed

This has nothing to do with her name, this has to do with people posting her address, phone number, and family information all over the fucking place.Comment

I am amazed how people are posting her info like this... Also... damn she is fine! Not as fine as Kobies wife though.
SIG TOO BIG! Maximum 120x60 button and no more than 3 text lines of DEFAULT SIZE and COLOR. Unless your sig is for a GFY top banner sponsor, then you may use a 624x80 instead of a 120x60.Comment

I agree posting her address and phone number and all that shit is out of line. Just pointing out the law that lets an accuser hide completely. I don't think that's fair at all.Originally posted by detoxed

First of all, I was talking about the assholes who posted her personal information, not about you. Second, you don't think this is a violation of that woman's rights? Kobe is a star, if he's cleared he'll be fine. This girl is going to have psychos calling her house, harrassing her at work and on the streets, putting bricks through her windows, etc. The assertion that Kobe is innocent until proven guilty but this girl is guilty of making false accusations even though there was enough evidence for the police to file charges is ridiculous.Originally posted by uno

okay, so I am not following this all that well because of being on the otherside of the Atlantic. Has this actually gone to court yet? Is she not still a potential rape victim? If so then how big is it to post her name, face and address.
I'm not for those accused of rape being named and shamed before trial either but unless she has been proved in court not to have been a rape victim then doesn't that seem just a bit wrong?
If it has been settled then I am even more out of the loop.Comment

There is a good chance he can lose 20 million dollars annually because of potentially false accusations. I'm not saying they ARE false. I'm also not saying he did or didn't do it. The accusations are potentially way more life shattering for Kobe than for the accuser. He'll be famous for a long time to come and things like this have a tendency to haunt. She'll have her 15 minutes and thats it. Anyone committing such crimes against her ("This girl is going to have psychos calling her house, harrassing her at work and on the streets, putting bricks through her windows, etc.") SHOULD and will be prosecuted.Originally posted by SpaceAce

Identify the bitch so all the people who she lied on before can recognize who she is and tell the court about what a fucking liar she is.
Making accusations and then hiding is bullshit!
If a person can stand up in public and back their claims then
their claims are fucking bullshit.Good luck.

Here's the problem with that logic. She has to prove she was raped, not the other way around. She is assumed not to have been raped by Kobe under the law, unless it can be proven to a jury. I don't personally think rape victims should be "shamed" either, but the legal system has to be allowed to function in the open.Originally posted by sarah_webinc

Unless she is underage, I don't think she has a legal right to anonymity once she accuses someone of a crime. The U.S. justice system is supposed to be based on open access, and mostly is except in special cases where it involves minors or "national security".
Personally, I think it's fucked that people are posting her home address, but I guess it's their legal right.Comment

Look at the other figures in sports and in basketball specifically. What could possibly give you the idea that this will cost Kobe any money? If he stands up in the courtroom and throttles the girl to death in front of the jury there will be ten teams lined up to recruit him when he gets out. Endorsements? Maybe, maybe not. Probably depends on a conviction. If he's convicted, he deserves to lose it.Originally posted by uno

Raw dollars are not the measure of life. Even if he loses $20,000,000/year from this he'll go right on making more money than most people can even dream of because, short of dying, there is always plenty of money to be had if you are a sports star.

There is also a problem with your logic. The only person who needs to know who the accuser is, is the accused. So what if her name never went into the papers or she remained anonymous from the public? She isn't accusing the public of anything, she's accusing Kobe Bryant. Kobe Bryant has the right to face his accuser and he will do so in a court of law. Everything else is a moot point. There is no reason for anyone besides the judge, jury, lawyers and Kobe to know who she is.Originally posted by Mr.Fiction

Unless the records are sealed for some reason, you can always go to the hall of records and find out who's who but there isn't some inalienable right to know everything about everything. If her identity were kept secret by the press it would simply be your job to go find out for yourself any information you felt you needed to know.

He's already admitted he commited adultry. Unless its an open marriage - his wife should leave his ass but she won't because she's too weak.
I doubt he raped her. I'll bet that she enjoyed what happened as much as he did.
They'll probably settle out of court by his side paying her a bunch of money that she doesnt deserve.
Regardless - he put his ass in a compromising position and is paying for it.
Maybe he's trying to get a job with the Blazers.

Guilty or not, You not gonna see his ass in no McDonalds commericals for a very long time,
Most endorsement contracts have a moral clause. They can back out anytime if it compromises the companyComment

The United States does not allow secret trials, except in very special cases. You can wait in line and sit in on the Kobe trial if you want to. That's part of our judicial system. Even though you don't have a vested interest in the case, the public always has an interest in the way that their judicial system functions.Originally posted by SpaceAce

However, your point does not really disagree with my point. With an open judicial system and a free press, not to mention the internet, things are going to get published one way or another. The only alternative to that is for the government to make laws trying to force the judicial system to operate in secret. That would almost always be more damaging to a free society than having victims names made public.Comment
