I am a customer of Paul Markham. I purchased some photos of a model named Luxi from his site.
This model is Luxi who operates a site of her own has been contacting my link trades and telling them I stole her images. I provided documentation to anyone who asked and she is further harrassing me and them because I am using the name Luxi on my website and also on my toplists such as PickaAsian.
Paul has written her but she insists that the release does not give anyone license to use her name. Paul sells the sets under the name Luxi. I can post the license if anyone wants to see.
Her harrassment is based on the fact that I am stealing traffic
from her on toplists and stealing her business. She is demanding that my traffic partners remove the 'fake' luxi and only allow traffic to the original model.
The emails I'm getting are threating harm.
She claimed she has Luxi and Luxionline trademarked.
We were not able to find these in the TESS and the UK trademark database. Her husband has now joined in stating that he has purchased an international trademark for these names.
There are many Luxi sites on Google, she is not interested in pursuing anything more than having me remove my sites and is not concerned about these other sites.
A few Gfy folks have been privy to this and suggessted I take this to the boards as the situtation is escalating.
This is a real problem for webmasters who purchase legal content from reputable providers and their attempt to hinder our business. Not to mention slander and phsycial threats are serious.

Otherwise, just tell her to take it to court. I highly doubt she will thou or you'd have already been served with atleast a letter from her lawyer. For instance, Cameron Diaz is a TM yet even she has to pay a photographer 4 mil to get a model release withdrawn.
