    Online gambling illegal in Canada?

    Is it illegal for someone to gamble online in Canada?

    I have looked around a lot through the criminal code, and as far as I can tell, it IS.

    I have no attorney, so I wrote a few Canadian gaming law ones but haven't heard back from anyone.

      Probably is because the govt can't tax it, that is they can't tax the owner/operator. Winnings are tax free so I doubt it has anything to do with the actual gambler.

      Cant say for sure though, but hey we can marry our manlovers and get high doing it so its not all bad

          i dont think its illegal.. but if u start receving big checks.. u have to cash them, and those u have to declare

                  Umm I have done that, a couple times at least. Keep in mind I own an affiliate program, not a casino. The casinos are actually owned by other offshore corporations. Not to mention this thread is talking about individuals gambling online, not operating online casinos. I don't gamble, not even VLT's.

                      The advice I just received from a lawyer a few minutes ago is to steer clear. Even promoting an affiliate program is questionable at best. See section 202. Although it does not mention online specifically, it can certainly be interpreted that way.

                      Promoting that activity is also punishable by law.

                      advertises, prints, publishes, exhibits, posts up, or otherwise gives notice of any offer, invitation or inducement to bet on, to guess or to foretell the result of a contest, or a result of or contingency relating to any contest;
                      I guess it is something I took for granted as LEGAL without ever thinking, in this day and age of VLT's and whatnot.

                      There were several companies who wrote SOFTWARE for online gaming but put the servers offshore, but because their software company had an email server in Canada, they were raided and charged.

                      On that advice, I would refrain from gambling or promoting gambling online. Just for everyone's info, take this whatever way you want. I'm certainly glad I asked before I did it

                          You can run a Casino and Host it in the Indians Territory 30-40 min from montreal, no tax, no bullshit, you can even sell weapon of mass destruction, drugs cigarette etc.. no problem

                                  Yeah, that appears to be how a lot of people get around it. I see certain native populations have set up gaming commisions specifically for that purpose.
