    Bloggers Gain Libel Protection

    The Ninth Circuit Court of Appeals ruled last Tuesday that Web loggers, website operators and e-mail list editors can't be held responsible for libel for information they republish, extending crucial First Amendment protections to do-it-yourself online publishers.

              This new ruling is interesting in that formerly the site operator was not jointly responsible with posters for what appeared, only if the site was "interactive": ie posts were listed automatically without being approved first.

              The former definition also applied if copyrighted material was posted to such boards. I suspect that is still the case.

                  This is very interesting ...

                  I have been blogging before blogging was a word.

                  In my situation ... although I guarantee any properely requested post will be posted ... I must "censor" posts because people continue to include personal details ...

                  On my website 100% anonymity is guaranteed (to the best of my ability).

                  The "netiquette" of my website is such that members expect me to delete their "names" and other details ...and often only include them because - they know this will occur.

                  It's not quite live.


                  Any thoughts on the legality of my website?

                      The new ruling - if it is upheld in the event of any appeal - suggests that you can now edit/review posts without becoming jointly liable for what they contain.

                          My thoughts on this were ...
                          If "godBUSH" could force WhiteHouse.com to go to "WhiteHouseSEX.com" then ... I wanted to ensure that SexEducation.com remained an anonymous "blogger" website.

                          Yes - we are growing up.
                          Probably not me ... ; )

                                          It actually got very little type in.

                                          I had about 5 negotiations fall through so I finally sold it to friends who run MoveableType.org after they got some funding(very nice blogging software.)

                                                  Man, I've seen the abuse people take on here for posting domains for sale. Maybe if I'm feeling brave.

                                                  I can't say exactly, but I felt it was worth between 5-10k. And they agreed.

                                                          And others I am working on - require more investigation.

                                                          I am investigating PHP based software, and even hahahahahahahahahaha based hahahahahaha blogging using a referring url.

                                                          XML based blogging I need to read more about.

                                                          However, right now I think I will direct those domains over to the official UBB website and use a board like this. I have no time to handle another server's security and upgrade issues.

                                                              well, blogs.com is 5 letters. But still, I agree it was a nice domain. Luckily I like and respect the people I sold it to and would be pleased as punch if they can make it into something cool.

                                                              And, next time I'll post here first.

                                                              Side note: A TGP is pretty much a variation on a blog. Daily links with minor commentary on each. If you expanded the commentary it would basically be a smut blog. hold on...okay, just registered smutblog.com. ;)
