I am from the USA so I can only speak about the USA...but a "living will" in the USA does not go through probate court and there are not any attorneys involved after the person dies...this is because named assets in the will are "virtually transferred" to the inhieritor prior to death through the "power of attorney". In the USA their are two types of "power of attorney" one is limited in power and the other is not.
