I swear My son did it!!

I just got this support request:

    "To whom it may concern,

My son used my Credit Card without my permission to access your sites content. What I need for you to do is remove him from the site, the information he provided is as follows along with the membership number.

    Name Used: removed (dad)

    User Name: removed

Email Address: [email protected] also belonging to me.

    Member ID: removed

Remove my credit card info from your billing cycle, and refund whatever amount you may have pulled out. Since this was against my authorization and my son is only fifteen (15) years old I apologize for any problems this will cause your site, this is not the first time my son has used my Credit Card info to access these kind of sites.

    Thank you for your help

    removed"

Would you refund this? Or would you tell him to deduct the charge from his "son's" pocket money to teach him a lesson?

I would applogize and offer him a free month of membership for educational purposes. Also, ask for his son's name and birthday and promise to send a free blow up doll to the poor kid.
I couldn't possibly know what I'm talking about, I'm completely, absolutely and definitively out of my fucking mind.

I would reply along the lines of, "Thank you for informing me, I will be glad to remove your information and refund your money. Also, as part of the cancellation process I will contact my billing processor with your information and they will make sure the card can no longer be used at any site on the internet they or their partners provide processing for. Those sites include (fill in number here) adult-oriented websites, DVD/movie sales sites and mainstream service providers. This should prevent future problems of this type.

Please respond to confirm this is what you would like me to do."

OK, I wrote that in five seconds. Clean it up and make it a bit more threatening.

Ask this guy for a faxed or xeroxed copy of his son's birth certificate.
Definitely cancel the guy's membership, but don't refund the money unless he can prove he's not lying. Be very nice about it... "I trust you understand that I receive stories blaming 'children' for the access nearly every day, so my lawyers have advised me to ask for proof of identity..." or somesuch.
Also get a log of that login's access to your site - and if the hours doesn't jive with a 15 yr old, list them in your email and say so.

Of course I'm NOT a lawyer, so you might want to speak to a lawyer before doing anything.

For the sake of what $25 - $40 its not really worth seeing a lawyer. Just ask for proof of his sons age and also tell him his card will no longer be accepted on any adult orientated internet site. See what his response is then!

My response would be to remind the guy that it isn't your fault that his son took his credit card and used it for something inappropriate.

Let him know you regret that a minor got access toy our site, of course. Then suggest that his son should be responsible for the money, as it will incur fees etc. for you. His lack of ability to control his son is not your financial responsibility.

Finally, tell him that if he really feels the refund is appropriate after considering that, that you will do him a favour and give it. Then wait for his reply before refunding.

                                I never refund such fuckers.

I gamble and 50 % of those guys chargeback or talk the processor into a refund. The other 50 % just cancel & eat the charge.

If your CB ratio is small enough go for it & take a gamble.

How much different is it, between you refunding them, and getting a chargeback, anyhow?

you guys like to talk bout "chargeback" like its common knowledge to a card holder

reality is that not to many surfers know what a chargeback is.

if his child took it then its gonna be an expensive lesson,

refund and forget. the only time we resist a little is when it's been recurring for 8 months and now they want a refund for all 8 because they didn't notice timmy's subscription till now.

Here's what I would do in your situation:

First things first. I'd email this guy and give him a list of reasons as to why his son is an idiot.
There are millions of sites on the net with some form of free porn or another, it doesn't take a rocket scientist to figure this one out. Strike one. He says this isn't the first time his son has used his credit card without his knowledge to gain unauthorized access to porn, so the kid is obviously stupid enough to try and get away with it again. Strike two. Point out that because of his sons utter stupidity, you are going to give him a full refund so that he can afford to bail his son out of jail when he decides to move onto bigger scores.

Thats what'd I'd do... If this guy is for real, then I think it's time he smartens up and hides his wallet when he gets home, cause as it stands, his retard son is just going to go and cost him another $39.95

                                        My

What about changing the login details, so that the son cannot access the site [but dad can], and cancel the recurring subscription?

Perhaps suggest that he could report his card stolen to the police, have his son arrested, and claim the $30 back on insurance

I am not sure, but in some cases the only way to get a "someone else used my card" chargeback is to report it stolen. In my opinion, if he isn't willing to charge his son with the theft, he shouldn't ask you for the money back.
