You got to be careful with models guys. Very careful. They can bite you in the butt with all kinds of bullshit claims. Take standard model releases and ramp them up to the max with as many extra clauses as you can covering everything especially full disclosure on the use of the pics.

What if I am not able to find it? I didn't archive it because I never shot her for any of my clients (only two clients wanted her and one had a stipulation that she'd have to shoot boy/girl). When a client asks for a shoot of a model I archive her photos and all legal docs onto DVD's that are stored in 2 different places.
But this girl never showed back up for her appointment. I never scanned or archived her release. Now I can't find it.

Well, complicated and overly-legalistic releases can bite you in the ass as well. A model who's being paid say $150 to $300 can't be expected to run to an attorney to pore over the release and give her his opinion or she'd end up with no money of her own, and probably a large legal bill. It would be easy for a judge to decide to set the release aside, especially since a pretty young woman is a much more sympathetic person than a "pornographer."Originally posted by KRL

The release should be written in English, not legal, and it should be clear that she is giving up ALL rights over the photos, how they are used, in what context they are used, with what text they are used, and so on. She further has no rights over how the photos are modified and she grants that these rights are transferrable to anyone who comes to own the photos later one.
As I tell models, "The purpose of the release is to leave you with nothing but your fee." (In fact, it's probably the one document a girl will be confronted with that there is no point in reading other than to look for loopholes.) A good release is already her worst case scenario.
Like any legally binding document, what was said outside the release is irrelevant. As I write in advice to models on my model site at ModelsPDX.com:
1) don't do anything you wouldn't want anyone to know about
2) ask where and how the photos will be used
3) read the release before the shoot and assume that anything it allows will happen sooner or later
4) then, decide if it's something you want to do, and have the nerve to say noSIG TOO BIG! Maximum 120x60 button and no more than 3 text lines of DEFAULT SIZE and COLOR. Unless your sig is for a GFY top banner sponsor, then you may use a 624x80 instead of a 120x60.Comment

A quick bit of advice. Everything that you say on the boards or in email is admissible evidence. Plaintiff's counsel will simply subpoena all emails and chat board submissions. I suggest you stop communicating this way to anyone but your legal counsel. If the Plaintiff's counsel contacts you, refer him to me. Do not talk to him any further.
