I am curious to know how many of the content brokers out there have actually *seen* any of the custodian of records information from the producers they represent.
It is great that they give the name and address of the producer... but what are they doing to verify that information?
Does the broker need copies of all releases and IDs to be fully compliant? .... or can he just pass the responsibility down to the producer?... or worse yet, the producer's agent...

Unless I overlooked something, David Lace's Title 18 info is only accessible after you log in to their site, but you've got them listed as compliant.
2257 has to be prominently displayed on the website...which means it must be readily available without registering or logging in, correct?

Webmasters need to get informed too.. THey trust that their content provider is covering their ass and doing things legally. But unfortunately a lot of people don't even know where to start.Originally posted by basschick

It's blind faith. Loyalty is good, but if you don't watch your own ass, nobody else is going to watch it for you, that's for sure. They can say they will, they might even intend to.. but it's always best to be armed with information. That way nothing can catch you by surprise. If more WEBMASTERS were a little more "paranoid" about 2257 compliance, more content providers would act accordingly. It's a vicious circle, really. Too many people coming into the biz with bright ideas and no real INFORMATION. They work on whim and conjecture, but don't bother to hunt up the facts. Aaron is giving a great big reality check and probably scared the shit out of a lot of people today, but better he does things this way here than them learning the hard way behind bars as Bubba's bitch.Comment

A broker should not only confirm that these records exist, but it's a VERY good idea to keep them on file as well as confirmation of this fact. We require full documentation for every content set we broker for other producers in an unaltered state. We will provide altered (for model's protection) documentation for webmasters if requested. However, as I say, I know we confirm this information and keep records on hand, I would assume most otehr brokers who are concerned with full compliance would do so as well.Originally posted by jcnlv

So remind me again why he didn't simply post explicit rules that each webmaster should LOOK for when buying content? Or post a complimentary thread advising adult content providers on the most common simple violations of 2257 so they could update their sites if they so chose? As Ralph Nader can attest, it's very difficult to make a difference standing out in front of huge corporate offices with picket signs. It is far easier to educate the consumer. However if Ralph Nader wrote Unsafe At Any Speed while he sat on the board of Ford Motor Co. he would have been laughed off the public stage. Sadly, adult webmasters are simply that gullible.

This may be a good option for you. Create one page with all of your providers and simply link it to your sites or galleries. In the case of sponsor content, talk to your sponsor and see what they suggest.

It would not hurt for you to spend a little and get a paid consultation with an Internet attorney. Same goes for pretty much anybody in this business. Not everybody can afford to drop a few grand for a retainer but a couple hundred may keep you out of hot water.
