What is more fucked up, the way that fucking bullshit state is from, or the fact that the man that controlls your country used to govern that state and enforced/endorsed the way that state operates and obviously believes that there is nothing wrong with the way that the state operates. #1 this shit goes on everywhere...this is not the only case of something like this happening so don't try to chalk it up as some sort of "Texas" thing. That just shows you're more ignorant than the average Texan.

#2 maybe the police were over reaching, but if you take into consideration all the photographs the context does get a bit shakey.

a. The couple took nude photos of themselves, 3 to be exact. Nothing sexually explicit, but nude still and turned them into the drug store along with pics on other rolls of the children naked.

b. The child was admittedly past the breast feeding stage, they got him to breast feed so the boyfriend could see it and they could photograph it for posterity

The charges centered on a single photo, the breast-feeding shot. Fernandez and Mercado say they took it--although the child had ceased breast-feeding--to memorialize that stage of their baby's development.

"We wanted to see if he would take it, and he did," says Mercado, explaining through an interpreter that it was a spur-of-the moment notion to which they gave little thought. "Johnny never saw the child breast-feeding, so this was for memories. For us."

c. Take a look at the breast feeding photo.
It's on the 2nd page. They put it over a picture of the Madonna breasfeeding but compare the pictures.
- The madonna holds the child in a nurturing position, like you would hold a baby.
- This mother is on her knees on the floor with her top off while her son stands naked leaning over to suck on her breast. This does not look like your standard breast feeding position.

So you take all this and try to make sense of it, the cops got worried as is their job.

I hope the judicial system whether it be criminal or family courts find the answers in all this muck and do what's right.

Photos of my cat, my house, my nephew in a bath tub.. and so on. Why would you even think one second of not getting those pics developed at your nearest local drugstore ??? You have nothing to hide, neither did she!

If you did, and were a moron. you would bring them far from your home, use a phony name and address and so on.

Child porn peddlers are much more "dstreet smart" than to bring them to a local store.They either have their own developping facility ( dark room), use video or digital camera.

Yeah, but with the law these days, it only takes one picture & one clerk to blow it all out of porportion. There's more laws nowdays than 10 years ago about child pics & no one can take good old fashion photos like they used to. It's sad really...

I'm in Lincoln Nebraska.... and i've already been investigated by the local police..... and the local police are always on the lookout for my camera crew(s)...... (trying to catch them getting a girl to flash them, so they can give the girl a ticket)....... i've been on the news twice (two local tv stations)... been on the radio alot..... and now a newer local tv station is doing another expose on me.....

I personally enjoy the heat..... heat brings exposure..... exposure brings awesome sales..... and awesome sales brings added legal protection.....

hmmm, there is a very famous photo of Jerry Hall (Mick Jaggers ex wife) breast feeding their baby in an issue of Vanity Fair. I think the photo was taken by Annie Liebovitz.

The recreation of breastfeeding for a photo is a little weird though.

Its a shame, its swings all one way or the other. There is no middle in this country. There are lots of cute innocent naked little kid pics in family photo labs all over this country especially from families in the 50-70's. They are just cute pics nothing sexual. Now back then protecting kids was a little lite and kids have to be protected but now its gone to extremes. I remember being 8 and acting crazy in the store and my Grandmother giving a good slap. I never acted out in a store again but today she would been arrested . We need middle ground and common sense which will probably never happen lol. Remember folks we got to get out and vote in 2004 you can make a difference. If Nixon had only more vote in every district he would of beat Kennedy the first time he ran for president.

Public defenders routinely suggest plea bargains, innocent or not, to close it as quickly as possible.

Duh!...

If the newspaper thinks the photo is CP why would it be up on their site (even modified)?

If anyone here seriously thinks the photo might ultimately be actionable, why is there a link to it from here?
