The only reason i ask is because i've acquired a large amount of beach pictures and a good amount of the girls seem to be underage which worried me. Then I thought of all the teenage girls in bikinis in the Sears catalouge et. al. I don't want to get in trouble. Of course I'd like to exploit the teen niche in a different way, but none of these girls are posing sexually suggestive and were all at public beaches just getting sun. That is not hurting anyone, is it?
With all the other "safer" content out there to shoot, why put yourself at risk. As Adult webmasters/ content producers we all are under the gun, the trick is to make yourself a harder target to hit then the next guy. Shooting 15 year olds at the beach is like wearing a bear skin rug out in the woods during hunting season.

A Sears catalogue isn't being sold primarily so that people can masturbate to it. The courts will know the difference, and your cellmate Bubba will too.
if you're selling it you're not fully legit unless you can produce proof of age and model consent forms for all the "models" - if you wanted to cover your ass. but if this shit is just random... don't know man. wonder how girls gone wild ensures they don't have any chicks on there under 18 that just look legal?

They were recently busted for having a few underage girls un a bathroom on film, one was 16, 2 were 17, but they had them say they were 18 on video.
I can't say if it's "illegal", but I do know we wouldn't approve you for a merchant account. Many of our merchants show show pretty intense content, but if the model looks underage we won't approve it...

If they're clothed (even in just swimwear) and they are just incidentally in the shots (they are not the subject of the shot) and the camera angles aren't such as to be lurid, I think you are legally okay. I'm also assuming this is in a 100% public place (not private land, where what is public and what is private is more muddy).
Ethically, I don't see any problems unless your presentation makes the scene seem "adult," in which case you might be open to a "false light" suit.
In short, if there's no nudity, the beach is publicly owned, and your application is totally non-adult, I don't see any problems.
