photo release issue

    photo release issue

    while staying at a resort last week there was a photographer at all of the various activities.....he took many pictures....both posed and candid....today I got an email from the resort directing me to a site where all of the pictures are posted....

    they are not charging for the pics....they are just there for the guests to download.....if they want to....

    my question is: can they do that???

    what if I were with a girlfriend and not my wife....and somehow she saw a picture of us....do I have any recourse?

    did it actually happen?? I think they have no rights to release your photos without your permission. I think you have got legal rights on that..
    No signature.. I am bored of the signatures aswell..

      There are going to be several factors involved in this..and it still doesn't make the issue black and white..

      One thing against you is that you knew he was there, yet neglected to ask him not to include you in any pictures.. second.. you were in a public place and the legalities surrounding public situations are sketchy at best. He's not using the images for profit so he's not really "gaining" from them, per se. You could probably ask for him to remove them and I'm sure he would, but your grounds legally wouldn't be all that strong, I don't think.

      If he was using the images for profit, THAT would likely be another story.

        fubarwebmastersadventures.com - How many of us have signed a release for JFK to use our images? I would sure him but I have no practical use for Canadian money.

          I'm not an attorney, but...he said it was a "resort," which raisesa question: If it was on the property of a resort hotel or club, you are in a semi-private situation assuming anyone could wander in off the street. If the property owner was allowing images to be made, he is probably the only one who needed to be asked. Out on the street, in a truly public place, you have no privacy rights because you have no privacy in public.

          Also, is this resort in the US. If the resort is outside the US, it's a whole different ballgame.

              No dear, I was on the side that he couldn't do anything about it and didn't neccessarily need releases. HOwever people in situations like that COULD ask you to take the pics down, and they MIGHT even sue you for it, the liklihood of them winning though is slim to none

                Aren't those tapes done of girls flashing in public places? Also, they were obviously playing to an audience with flashes popping right and left, so they more or less were giving tacit permission to be photographed.

                  Yeah.. If it's private property that's another situation altogether, and I wouldn't be too sure about the legalities where that's concerned. In most cases where these kinds of pictures are taken though, the person puts them up until asked to remove them, and generally if you ask someone to take pics down, they will. Very few don't. Once the damage is done in a situation like that though, I'm sure you could sue for loss or whatever, but that's for a DIFFERENT episode of Jerry Springer :P

                      If a club charges you a cover charge to come watch their wet t-shirt contest is that still a public area?

                            They just offer the service for the average tourist to download some vacation memories. You saw him taking the pics you did not object or leave so you are basically out of luck. You can ask him to remove them but thats all you can do.
