even though it is in bad form for a sponsor to use an affiliates gallery design with out talking to them prior - i have heard from several lawyers and wannabee lawyers that it is technically legal for them to do it.Comment

a niche is an IDEEA, you can use it as long as you don't make copyright infringements (such as using the site name you're copying a bit modified, stuff like this).
