I've already answered this in my post. CP does not = nude.
You can photograph a fully clothed minor but if you focus and zoom in on the genitals you can be charged and convicted for producing cp, it's all about context.
If the guys were taking photographs that are judged to be gratuitous in nature they will get the punishment they deserve.
Now regarding art your example of a 12 year old in fishnets is a bit one sided.
We all know the implied sexual overtones of any female in fishnets.
Now if you have a completely nude girl even younger than 18 in an environment that does not scream sex, that might be considered art. We can judge on an individual basis that it is not art, but it will be up to the supreme court to judge on a constitutionality basis and they have already done so.

Don't confuse the bad nonnude sites with the good nonnude sites. There are a few nonnude sites that only list galleries of sponsor content that shows obviously legal girls in bras and panties. These sites are good for webmasters since the less nudity you show in your gallery...the more likely the surfer is to click through to the actual site to see the nudity.
Ex. You make a free site full of Lightspeed galleries of Tawnee Stone and XXX Raimi in bra and panty shots. The conversions on this traffic would be great.
I've been thinking of making a nonnude site like this for a while now. Using Lightspeed galleries and the content from a couple other sponsors.
^ I've been doing this for a long time and it works well even though I don't get a lot of traffic. I used to have snapshots of girls 16-18 on my site (I started my non-nude "career" when I was 17), and I even promoted Jim Grady's sites for awhile (don't tell the FBI) but in the end I could see why most people equate non-nude sites with child porn, and I finally changed all my sites to 18+ content and adult sponsors.

What I do is tell them that I'm a well know, respected webmaster in the adult community and that unless they remove the content in question that they are going to hear from the adult industry <YOU!!!>. Of course most of these sites don't actually have child porn but they where very suggestive.
I have to tell you that at times I've wonder what I would do if someone called my bluff since I know for a fact that most of you don't like to get involved in shit like this.
Anyway - buddy thought that he would get away with taking advantage of under age girls/boys and personally I believe that it will help those kids in the future - knowing that this pervert is behind bars I mean.

That he was acquitted of all charges.
