      To make another point, why has the owners of the mall not taken issue with the store?
      Accessory to or supplying of offensive materials(by their standards)

Unless the Mall has some photo documentation of the same guy wearing the same shirt causing a disruption -- these are just retarded allegations.

            This is why all government collapses. To be balanced we need multiple parties, but if we have multiple parties they're always going to be fighting. Each election is like a civil war. Inevitably every government will collapse, just some slower than others. Authoritarian Socialism, or communism collapsed because the idea of authoritarian power in a socialist society is absurd. Capitalism is collapsing because of the continually increasing gap between the rich and the poor and the distribution of wealth. Soon the rich will have ripped off the poor so much that the poor have no more money to feed to the rich.

                                I just think we need to apply reason to the law and not take it word for word. I don't think that they should take them all away either, it should just be a case by case basis. For instance, if you own a mall I think the mall should be considered public property. After all, it is considered a public place. The owner, if operating a business should not be able to apply the same rules he would to his own home.

                                      We postponed jurisdiction of this appeal from the Supreme Court of California to decide the important federal constitutional questions it presented. Those are whether state constitutional provisions, which permit individuals to exercise free speech and petition rights on the property of a privately owned shopping center to which the public is invited, violate the shopping center owner's property rights under the Fifth [p*77] and Fourteenth Amendments or his free speech rights under the First and Fourteenth Amendments.

                                      I

                                      Appellant PruneYard is a privately owned shopping center in the City of Campbell, Cal. It covers approximately 21 acres -- 5 devoted to parking and 16 occupied by walkways, plazas, sidewalks, and buildings that contain more than 65 specialty shops, 10 restaurants, and a movie theater. The PruneYard is open to the public for the purpose of encouraging the patronizing of its commercial establishments. It has a policy not to permit any visitor or tenant to engage in any publicly expressive activity, including the circulation of petitions, that is not directly related to its commercial purposes. This policy has been strictly enforced in a nondiscriminatory fashion. The PruneYard is owned by appellant Fred Sahadi.

                                      Appellees are high school students who sought to solicit support for their opposition to a United Nations resolution against "Zionism." On a Saturday afternoon they set up a card table in a corner of PruneYard's central courtyard. They distributed pamphlets and asked passersby to sign petitions, which were to be sent to the President and Members of Congress. Their activity was peaceful and orderly, and, so far as the record indicates, was not objected to by PruneYard's patrons.

                                      Soon after appellees had begun soliciting signatures, a security guard informed them that they would have to leave because their activity violated PruneYard regulations. The guard suggested that they move to the public sidewalk at the PruneYard's perimeter. Appellees immediately left the premises and later filed this lawsuit in the California Superior Court of Santa Clara County. They sought to enjoin appellants from denying them access to the PruneYard for the purpose of circulating their petitions.

                                      The Superior Court held that appellees were not entitled under either the Federal or California Constitution to exercise [p*78] their asserted rights on the shopping center property. App. to Juris.Statement A-2. It concluded that there were "adequate, effective channels of communication for [appellees] other than soliciting on the private property of the [PruneYard]." Id. at A-3. The California Court of Appeal affirmed.

                                      The California Supreme Court reversed, holding that the California Constitution protects "speech and petitioning, reasonably exercised, in shopping centers even when the centers are privately owned." 23 Cal.3d 899, 910, 592 P.2d 341, 347 (1979). It concluded that appellees were entitled to conduct their activity on PruneYard property. In rejecting appellants' contention that such a result infringed property rights protected by the Federal Constitution, the California Supreme Court observed:

                                      "It bears repeated emphasis that we do not have under consideration the property or privacy rights of an individual homeowner or the proprietor of a modest retail establishment. As a result of advertising and the lure of a congenial environment, 25,000 persons are induced to congregate daily to take advantage of the numerous amenities offered by the [shopping center there]. A handful of additional orderly persons soliciting signatures and distributing handbills in connection therewith, under reasonable regulations adopted by defendant to assure that these activities do not interfere with normal business operations

                                              We don't have the whole story but it sounds to me like the mall security guard probably overreacted, was being stupid or whatever. I think nearly all of us agree that someone should be allowed to walk around with a shirt that says "Give peace a chance". Maybe the article left out the part where the guy wearing the T-shirt flipped off the security guard and belligerently screamed "you stupid dumbass hillbilly hick motherfucker!" at him. Who knows? You know how those six dollar an hour rent-a-cops can get sometimes.

                                              This board is a prime example of small little innocuous statements getting out of hand. Should we really assume the same doesn't happen in a shopping mall from time to time?

                                              So anyway, the security guard is pissed off now. Maybe his father was whacked over the head by a peace protestor in 1972 or something. Maybe he was sitting around drinking beer all weekend long mumbling under his breath about the "hippy protestors" that he had been in a screaming match with during the week. "Damned hippies!" He decides to get even. Pulls out his trump card. Hits speed dial and rings the police. "Hey, this guy is trespassing. Arrest him!".

                                              The police have to respond because that is the law. Technically, the guy is trespassing. Maybe the guy had a chance but was being an asshole to the cop. You know how people get around authority figures sometimes ("Fucking pigs!"). T-shirt guy gets arrested.

                                              So what? This is really supposed to be a statement about "the state of America" or proof that "America is one fucked up place", "the craziest place" or that the first amendment is now null and void? This story is not evidence of any such thing. If you already believe that, so be it. Nothing will change your mind.

                                                Lots of good points here. This is how I see it.

                                                When it comes to the press, you've got to know if they are liberal or conservative as you are reading. Based on the fact that they left out a lot of pertainent information (i.e., the other side of the story, what exactly they did to be asked to leave), it's probabaly liberal.

                                                So, the only facts you can consider are:

                                                1. they were wearing 'peace' shirts
                                                2. they were asked to leave and didn't
                                                3. they got arrested

                                                As KRL stated, if you own property, you have the RIGHT to ask someone to leave. Period. If they don't leave, that is grounds for the law to come into play and protect your property.

                                                PornDude, as sad as it sounds, people can, and do, have biases towards who they will do business with. The law says we cannot use race, religion, or sexual preference as the bias. However, they can use any other excuse that they want. It happens everyday.

                                                I'll share a story. During the last election, someone I know who is apart of the Greenpeace party attended the Gore rally and protested while wearing a shirt that said, "fear the evil Gorebot". He was arrested and later released. He was in an open area, with other protesters, but was singled out for his shirt. No one came to his aid because he opposed Gore. Sucks, but a true story.
