I don't see how this can be a problem. I have seen gallery design done by designers for some of our affilliates that include all or part of my logos, and my thought is that they will be sending traffic that is more targetted. Maybe I am missing something?Comment

I don't think there is anything wrong with it, but as I keep saying, once you slap a price tag on free promo material you didn't completely create it creates other issues.
And there is nothing worse than a designer taking credit for other designers work. We all know this.Comment

So then what is someone paying for? This honestly doesn't make sense to me.
Do you pay for the graphics, layout, thumb size? What I cannot grasp is why would someone want to pay another to assemble a bunch of graphics and thumbs from the sponsor's free promo content?
Maybe most people just aren't capable of doing that themselves, and that is why they pay someone else to do it?

I wanted to sign up with ddf-cash (Denys DeFrancesco) the other day, but the pop-up window with the conditions clearly stated something like
"you're not permitted to use any images or other parts of our sites to promote our sites..."

Did you see the 2 different templates ? The only thing that was "reused" was the Text Logo. It said "Blood Dolls". I'm sure that he thought it was just the sites logo and not something another designer had created. I don't mind people using my design elements in their work. As long as they ask permission. I even offer all sorts of images that I am okay with people using pretty much sight-unseen.

This is making me think.... so I can pull logo's and graphics from sites, throw in some text and a couple more graphics to make a gallery, and sell them to people for $30- $40? For specified sponsors. Is there really a demand for this?
Because I have been under the impression when you purchase graphic design work you are buying original created stuff, different from the site but maybe similar.

What am I twisting ? The promo area contains free content, hosted galleries, etc.. I think they're coming down harder on Tuga than is necessary. He didn't steal someone else's work. I think it's alittle more than just assembling the existing graphics, and even if it weren't, then yes there are webmasters with lack of design skills who can't even do this. The galleries that I've seen made for my affilliates by designers have not been 'just assembling the graphics'. It takes an eye for layout, for flow, and for sales text. Affiliates can use them, but designers trying to market a service, as in 'design skills' based on snagged graphics - should not resell graphics.
I was not paid for a logo on that. It was a template. Logos are more, like 150. In that fee you release rights for the logo to be used and reused.
But you dont get those rights on a 25$ template jack.

That's not the site logo. I was speaking of the site logo. As a designer, I would not copy an existing hosted gallery from a sponsor, but I would incorporate text and images from the actual site tour. I also do all the designs for our hosted galleries, though... so if someone dis do this with my stuff, there wouldn't be an issue like we have here.

I understand the issue. I just don't agree with it. I've got traffic. I can't design. I pay other people to design templates or sites for me. If you have a promo tools area, and hosted galleries for me to use.. I'm not aware that I can't get a designer to create something unique for me from it unless I'm told. So that's my fault. I understand, when in doubt.. ask first. But on that same note, why would I want to even bother at that point ? Here's a simple way to understand the whole thing. A well-meaning designer made a mistake, thinking that a non-standard logo was the site logo. I don't blame him, and hope he will do a design with the real site logo.

When I buy gallery designs / templates for my sites I want to own them 100% outright.
Any use of any design or text elements to promote my sites is actively encouraged
I have never seen this middleman designer case before but its not really my business whether my affiliate made the thing himself or paid someone to do it. If an affiliate is using design elements I own to promote my sites I am happy.Comment

The people you do have to vigorously protect are the gallery builders who make their own templates to do their own promotion, only to see them ripped off by tgp owners etc.Comment

If you hire good designers you will not need the logo of the website to promote your galleries. It's a good thing though using the logo of the sponsor, it helps conversionsComment

Well Every sponsor I have talked with gave me the ok to do just this, I don't charge for custom graphics I charge for resizing, adding the images, making them templates so all you have to do is drop more images in the dir and bam you have a fresh gallery. I do custom graphics, banners, logos for others as well. But I find the webmaster is more happy if I make their galleries look more like the sponsors website. Think of it this away, if the sponsor is making money off their layout, text etc... don't you think you would make money promoting it that away as well? *shrugs*
But I only charge $5.00 to $8.00 not $25.00 to $50.00 if I did that then imo that would be stealing and reselling the sponsors graphics. The way I do it and YOU may disagree ( i got the ok from the sponsors) But I only charge for the time it takes to grab the images, redo the tables, rename the images, resize and sometimes put my own text.

Now - if you guys running the paysites make sure you completely own the logos and graphics a designer did for you, why don't you ask them straight away to provide clean versions (separate from the tour pages) to be re-used on gallery templates, etc., and post them as advertising material?!?Hint to sponsors:
release a few neutral-background images and header graphics to be used in templates - I find it very tedious to have to cut the logo of a site from a tour page with fading or overlapping background images!
With the current trend of full page gallery templates this would be a great help to all designers.
Or if the guys who did the original work are greedy there could be an extra clause saying something like "if you're planning to sell your work/gallery template please pay the creator of the graphics $x.xx [like $3-5 seems to be reasonable for a template worth $25-35] per graphic used in your design"Spam me with design ideas for my signature - LOL!Comment

When having a designer do work for you, you should have them sign a "work for hire" contract. This will assign *all* rights to you, so you can do whatever you want with the deliverables. If you do not sign any such contract then if you are sold a gallery template, you may be violating the designer's copyright if you use parts of it (such as the logo) for other purposes (you purchased the rights to use that logo in a gallery template, no place else). I'm no lawyer, but I frequently read law (I have setup several businesses myself, with no lawyer fees) and copyright law is complicated as shit (thats why copyright lawyers make the big bucks).FTVGirls simply convert better.
