If I was Platinumbucks, I would have sent him his $385, announced it, and told him to get the fuck out of my face and he is to NEVER promote my shit again. I would have gotten respect from the webmasters for paying him to squash it, and I would have made hooper look like a fool if he ever tried to keep promoting my program.

And it would have only cost me $385...

I totally agree with PB taking action here, their brand is worth a lot more than $400 and Hooper intentionally tried to ruin it.

Discovery is a wonderful thing in lawsuits... and it works both ways.

Once someone is served, attorneys can ask all manner of things, which may or may not be related to the matter -- it's not like court where you need relevance.

And once those depositions are recorded, they become public record.

Why do you think that all the major companies would rather settle out of court for huge amounts of money when they are challenged, especially in class action challenges, than try it in court? Statistically, I believe it's 95% of PLAINTIFFS lose in civil court if it goes to trial, of course you only get a tiny percentage that end up before a judge or jury.

Most judges will refer the litigants to arbitration initially, but if it cannot be settled that way, then a trial it is.

I noticed you included the title 'communications and marketing' in your sig...if that really is your job and you really do keep posting this stuff someone should fire you.

I have to state an opinion here.. Platinum Dave is a weenie! And here's why..

1) He's talking about "slander" suits.. everything written here is just that, written. Written defamation (if it can be proven to be defamation) is called LIBELOUS defamation, not slander. How much are you paying for lawyers with a kindergarden education??

2) Dave threatened me with a lawsuit of similar nature when I went on message boards and told about how he refused to pay me $200+ because I made it publically known that he had changed the rules of a publically offered contest, during the contest's duration and then again after the contest's completion, to which I had fulfilled the necesssary requirements for winning the cash prize. In the US that type of behavior is called fraud. I wasn't about to get into it with him, because the money isn't worth that much to me and I could tell that business with people like that wasn't for me in the first place.

3) Whatever form of defamation it is, the US Supreme court has already ruled that most online communications (eBay feedback being an exception) are not covered by defamation laws. Message boards were included in this.

4) In order to bring a defamation suit, the prosecution must prove that the statement was false AND that it either caused a loss of income (present or future) or ruined their standing within a particular community or culture. Dave, your reputation with a number of webmasters is already in the toilet after several similar issues (whether it was your wrongdoing or not) in the past. And as someone else said, are you ready to open up your files to a 3rd party and prove that you don't cheat?

5) Dave's micromanagement of $200 here and $400 there is indicative of what I feel are poor business practices and a real lack of respect for other people, regardless of their standing within the self-created adult webmaster/entertainment community.

6) I don't know all the details and didn't look at the numbers in depth, so I don't know who really is right or wrong, I'd guess that both are to blame in part, I doubt any of us have all the information regardless of what either of them say about "here's the full story." That notwithstanding, Dave's refusal to appease this guy and get on with business, to me, says something about the way he goes about his business in general. For an industry that strives to maintain its legitimacy in the public eye, the dirty dealings and downright lack of respect among different levels of success gives everyone a real black eye.

I was banned after completing 2000+ posts, at 5 cents per, and was never paid. Manipulation of original rules by the moderator. You can't change the rules in the middle of the game.

I'm not bitter, I am representing those who have a sense of equity and fairness towards others. It is a matter of principle, not dollar signs.

The vote was not unanimous, in fact at the time I was banned there were more people voting for my to remain than leave, and even so, of the several hundred webmasters registered, no more than 30 voted by the time I was banned.

If PD settled, he would have admitted guilt. Think of the reaction he would received from other Webmasters currently promoting his program. They would drop like flies, costing him more than $385. Reputation and goodwill is very important...Platinum Dave has every right to squash defamatory accusations like that.

On the other hand, if those signups were legit (which will all come out in court if it resorts to that), PD has some "'xplainin' to do!"

All of that could have professionally been handled with something as simple as "Hooper we refute your claims, and here are the screenshots to prove our statements"... but instead you resorted to name-calling.

No amount of money, or number of lawyers, can repair the damage you've already done to yourself.
This is a business - no matter where you're posting, you're representing your business. No one can do as much damage to your business as you can.
