ATTENTION: I have taken the ACACIA issue to the mainstream and am making this public

I know Holio and homegrown vid. are orchestrating a legal fight against ACACIA...I believe that in order for this battle to be won, we need to fully expose the extortion efforts of Acacia. Therefore, I am taking it upon myself to orchestrate a public fight to bring this into the internet community?s attention. I have started contacting the major news organizations regarding what Acacia is doing.

Today I heard back from the producer of the Online Tonight show with David Lawrence that is aired on CNET and over 90 radio stations across the nation.
    cnet.com/broadband/0-7227152-7-7228989.html

The producer is now contacting the Acacia legal team to get a better perspective of what Acacia is doing, and she wants to have a representative from the adult community on to discuss this with Mr. Lawrence. She stated that from what I have told her, she believes that Acacia is targeting the adult community unfairly, but will have to speak with both sides first.

I would be glad to speak with Mr. Lawrence on this issue, but I think it is better if we have either an attorney or someone who is very familiar with patent laws to be the public spokesman. I am contacting the Holio legal team as we speak to get this going.

FYI, I have not been contacted by Acacia, but I care about the welfare of this industry and I think a public campaign to make everyone else aware can be very much to our advantage. I will keep you all informed on my progress.

      Good luck, anything helps.

I was kinda surprised when my pack arrived, but not so surprised when it fell into the trash.

My favorite part of the pack is the sheet for affiliates, which has 20 spaces in Retard lawyers buying a patent and hoping to make bank.

To be honest though if I was a US based webmaster I would concerned, I do host in the states, but still at this time not really worried personally.

Whoever handles the PR for the adult industry on this case needs to very clearly and repeatedly state that this has little to do with the adult industry. What Acacia is trying to do is to stifle the development of the internet and make consumers pay more money for products and services by asserting an obvious and almost certainly invalid patent.

Again, they need to focus on this as an issue of greed, obstruction of future web development, and invalid patents.

Don't push it as "porn" anything, make it way bigger than that.

It's like the way that the adult industry correctly state that the free speech issues they are fighting for have nothing to do with the porn business and everything to do with the freedom that is guaranteed to every American in the constitution.

Someone needs to make people understand that this is not about porn, it's much bigger and has the potential to cost them money.

I think I missed the whole ACACIA thing -- what patent are they claiming to have? Al Gore invented the internet, so what's the problem?

They claim to own the patent on all video on the internet. All of it, no matter if it's streamed, downloaded as a zip file, or anything else. They want like 15% of your companies gross income if you have any video on your site at all.

I might not be exact on the details, but it's close to that.

why are they not after mp3.com, Microsoft and all other sites that run video or streaming music? They're pushing it against porn cause they think they'll have a better chance of winning it and then they can attack these other sites too. they know they wouldn't have a hope against any other industry.

I was not positioning myself as the spokesperson, I just didnt think anyone was going to approach this issue from a PR standpoint, so I decided to take the initiative myself. I have not even been contacted by Acacia, so I was doing this merely to help, but I understand what you mean about making sure its a unified effort. Contacting you now

As I said, we want to move on this level and we will have an established spokesperson to lead that effort... we just need to be very careful about what is said so that nothing is misconstued.

I am available right now if you can call tonight.

Direct from the Newtek website... http://www.newtek.com/newtek/milestones.html

                                        <font size=+2>1990</font>

This goal reached fruition in October 1990, when NewTek shipped the <b>Amiga Video Toaster®</b>. The Video Toaster® evolved from a simple premise: provide all the tools necessary to create broadcast-quality television in a single, accessible device. Not surprisingly, the established broadcast video industry greeted the Video Toaster® with skepticism, at best. Despite these marketing challenges, the Video Toaster® caught on with an enormous range of people who shared a desire to "make TV". It literally replaced hundreds of thousands of dollars worth of equipment for $5,000, and put sophisticated skills and tools into the hands of "average" people - from high school students to professional event videographers.

Those folks remind me of the idiots from several years back that claimed to hold rights to hyperlink technology. Needless to say, the supreme court laughed them out of the courtroom, but people were still scared. This is the same deal...only different.

Damn, if only years ago I would have patented eating or breathing technology.

Well done Meta, but Mr Fiction is right this is not about porn. The more people know about the whole copyright scam the beter.

I think Acacia will see they have bitten the tail of a very big dog.

It literally replaced hundreds of thousands of dollars worth of equipment for $5,000, and put sophisticated skills and tools into the hands of "average" people - from high school students to professional event videographers.

you guys also remember the days of BBS porn pre 1990 ? In 1989 you could log on to a BBS and download videos. Sure they were 300kb and 5fps but they were being sent through Acacia's 'patented' technology

                                                    Go to http://patft.uspto.gov/netahtml/srchnum.htm and enter:
                                                    6,144,702

You'll find the prior patents that it's a contuition of in the Parent Case Text.

I have been contacted by Acacia.. and I threw their shit
away.. it came NORMAL mail, if it were a serious issue.

I mean, with them contacting me, they would have sent
it legally so that they had PROOF that I received it..hahaha.

Anyways, I think its a joke.. they sent all this shit and
                                                      wanted money...yeah right!

I am with Holio on this issue.

Had they confronted the issue when the video/audio first started being used on the net, they may have had a leg to stand on, but in that such processes have become part of the standard operating procedure of the net, with continued widespread use, without objection from these folks, I doubt that they can all of a sudden start yelling, "pay up"

Here is another company with a patent for video across the net... wonder how this could be....

More than likely, and please realize this is purely my own speculation, the meeting will really be about soliciting support since I am pretty sure for the time being discretion is urged in terms of any information that is made public.

At this point, it is about getting word out to everyone in the community that this is a threat to all our well being and ability to conduct an internet business.

I thank everyone for the support and will make every effort possible on monday to outline what to expect for the next meeting planned for tuesday.

Any help getting this message out is greatly appreciated.
