            ok.. let me rephrase.

            We all know the TOS says 'This country is banned..blahblahblah".. and that isnt being argued.. I think what is being argued is the ethics involved in this issue. His signups have not been deemed fraudulent.. so why not terminate his account and pay him.. both ppl are happy, lesson learned.. no harm no foul? is that hard todo? Doesn't give siccash any bad PR, and the affiliate learns his lesson.

            I dont see why that wouldnt make everyone happy

                    If you really want to push a program and your in a country on their banned list, email them. Show them how you plan to promote the site and chances are they will allow you into the program. I know we have done it for a few webmasters with no problem.

                                Banning countries has absolutely nothing to with racism. It has to do with the fact that there's a large number of cheaters in that country, to the point where it costs the company money to allow them as affiliates. You're an honest webmaster? Email them with a reference and 95% will let you in.

                                    Big difference between Czechs in the USA and anyone who lives there. No one (that I know of) discriminates against race, just location.

                                    Beacause that opens the doors for every other webmaster from a banned country to join with fasle info, change it later, then demand payment. If they do this there's no reason to even have a TOS. Maybe if this guy had contacted Brad before he sent traffic and explained his situation they could have worked something out, but he didn't. He attempted to defraud SIC Cash, if they paid him I would be shocked, so would every program owner. Lensman, any thoughts on this?

                                                        Wrong, it's perfectly legal to not allow webmasters to join your program. As it's been said ten times in this thread, it has nothing to do with racism. This whole comparing it to "not allowing blacks" arrgument is ridicoulous. It's not the same at all, if you can't see that, well then you're about as smart as TheFly.

                                                        Sorry to everyone about being rude, but this whole arrgument has happend so many times over the years, and I don't understand how people can still be so stupid. It's not complicated at all, in fact it's one of the most simple things I can think of.

                                                        Program A doesn't allow webmasters from country B. I live in country B. Should I use program A? Come on my 7 year old would laugh at how simple this question is.

                                                                        With respect to all of the GOOD international webmasters... I have some opinions on the subject. But first I want to say that I appreciate my international SinTalk and SinHost clients.

                                                                        I prequalify every SinTalk customer to the best of my ability. I agree with the 90/10 rule, not 99/1. And, for the record, despite the fact it may be that way for US webmasters it is NOT that way for international webmasters.

                                                                        Outside of the US, Canada, England and Australia I've had TONS of problems. The bulk of people that I've talked to online are spammers or people doing other funky things. Getting a real url that's not a CJ or a landing page for their spamming is difficult. More than 50% of the international webmasters applying to my program get declined for these reasons. I must be hard to police a big program. Mine is small, I boot unproductive webmasters and I know almost everyone so it's a bit different.

                                                                        The joke of it is, though, that all the website affiliate programs work with spammers so what we see here on GFY is double talk. I don't and never could, if for no other reason than the strict FTC requirements on age and price disclosures associated with phone sex.

                                                                        However, I have luxury of talking to webmasters first... and I'm the first guy to sign up an international webmaster if we have a good conversation and he seems to check out. Without giving a multitude of affiliates the opportunity to succeed, you'll never be successful as an affiliate program.

Anyone can get mail in the USA. If there are any "banned" webmasters out there reading this -- I will take delivery of your checks and paypal you the $$$.

                                                                                                                You're going to have 100 scammers contacting you in the next ten minutes to have you cash checks, and some government agency will be contacting you very soon as well. Not all forign webmasters are scammers, but a lot are. Do I have to dig up the link to that scammer BBS? All anyone is looking for there are people to cash $10-20k checks in the USA and then send the money elsewhere, for like a 20% cut. Yeah that's a good business to get into Fly, smart move.

                                                                                                                                    With regard to spamming, the spirit of this thread is about "TERMS AND CONDITIONS". Webmasters that spam, send poor traffic and commit credit card fraud are usually at the root of such a document. Again, it seems you missed the jist of my post. My point was that my overwhelming experience with foreign webmasters is that they're perpetrating some kind of fraud.

                                                                                                                                    However, to add balance, I make case by case SUBJECTIVE decisions. It's my company, I'll choose who I want and don't want representing it.. I have many international webmasters that do an excellent job and I'm glad they're in my program.

                                                                                                                                    It occurs to me that the whole conversation of booting webmasters should also be conjoined with the question of how do programs pay $35-$40 per signup.

                                                                                                                                        It is quite common practice for me to start sending hits to sponsor, make some sales, and THEN write email to them about "I am from Czech, let's talk about your TOS" ... So they can see what kind of surfers am I sending to them and that I am able to make them some extra cash.

                                                                                                                                        As Miguel said, they did not answer to any of his emails, they just sent some checks to him ... For me it could be something like "WELCOME" Answer...

It's my company, I'll choose who I want and don't want representing it.. I have many international webmasters that do an excellent job and I'm glad they're in my program.

                                                                                                                                                It occurs to me that the whole conversation of booting webmasters should also be conjoined with the question of how do programs pay $35-$40 per signup.

It's that siccash let him send more and more traffic for a long time while still promising payment while no checks were sent. That i call crooked and dishonest, the best thing to do would have been to contact the webmaster and inform him of his country ban.
                                                                                                                                                            Pay what you owe for the signups, ban him and get on with life.

If you'd sent him cheques before, and he got them, and he cashed them, then you must have been putting the right country on the envelopes? If that was *your* mistake by sending those initial cheques, then I believe it's your responsibility to pay up and end the relationship there cleanly.

You know you're breaking the TOS, and they don't owe you anything, even an e-mail. Joining a program is like legally signing the TOS. I assume if the sponsor choose not to deal with you you wouldn't come here and say he owes you money.

                                                                                                                                                                                                        The TOS was there all along, and they stopped paying as soon as they figured out his SCAM. The point here is if you deliberately break a sponsors TOS, you shouldn't be and probably won't be paid. fucking period.
