    models and domain name question

I have a lot of content of a model that I do pretty well selling, and the domain name of her stage name is available.

Do you think I'd run into any problems by grabbing her domain name and making a site with just her content, or do you think I'll end up getting a cease and desist letter from doing this?

I dont want to go through all this trouble of making a site around her only to have my site shut down later.

I mean if brianabanks.com was available and you took that domain and made a paysite out of it with all Briana pics, do you think that would be cool or not?

I have a few such sites in the works, and one up already. None of the models mind.. though two of them only work with me. I guess it depends on how big an item the model is... But if you have a model release, it may well cover using her name.

If she does not have a copyright on it she can do nothing.

You could do nothing if someone used your mothers name for a porn site, there are lots of times peoples names are duplicated all over the world, unless you copyright it you can't do squat.

I would say if you think you can make money, go for it, I would.

          Just my thoughts...

She can't do anything. I have about 5 domains of Briana. I can use them to promote whatever I wish. I can't imagine her stage name is owned by anyone. These things aren't thought of when girls start stripping.

No, it's content that I bought a lot of sets of over time. I dont' have a release, just the licenses.
Whenever I need a teen set I buy her stuff first.

Doing a search on the web theres not a lot of sites with her content on it, and I'm suprised.

I guess since she isn't very popular like Brianna or Gauge I could just give her a different fake name.

another thing to keep in mind, is the nature of the site.
ie. if youve got people coming in because of they are typing her name into search engines... Then faiir play, but if your using her name to deliberatly mislead the public, as to the site really being her own, then you could run into some probs with deception etc...
Best bet, (4 allconcerned) would be to contact the model, and offer to put up a site fotr her, and split the profits... then you will get 'free' content of her for life
I have a very good model friend whose name was taken and held hostage by a big company... allthough she couldnt get it back, they are not allowed to pretend that its hers...
now, it leads to all sorts of shit (CP) etc...
                swings n roundabouts i spose ;-)

I think you guys are wrong.

This might be a bad example, but Lightspeed Media owns the copyright to Tawnee Stone. There are thousands of domain names similar to her stage name, and if they aren't one of our webmasters we have the right to sue them to take ownership of that domain.

With Briana you can buy a related domain name, but she might have legal grounds to come after you in court. She has a much more vested interest in her name than the webmaster does.

                    build the site

you can always move it to another domain later if there is a problem

                    simple.

That's because you own the copyright to the name Tawnee Stone. If this girl doesn't own the copyright to her stage name, then I don't think she can do anything.

I bet Gauge doesn't own many, if ANY of her pictures. The photographers/producers do.

When a model works with many photographers and producers, I don't understand how someone could claim copyright infringement. It just doesn't make sense to me.
