Its not my opinion, the DOJ stated it themselves during the flap over CPPA.

I'm not saying its a good idea. They might not be willing to intiate a prosecution themselves over it, but if one of the girls parents ever saw that stuff online and went to a DA, you'd be praying for death before they got through with you.

The odds of that happening might be long, but the stakes are so high it should be prohibitive.

In the United States you are presumed innocent until proven guilty in criminal matters. If you'd bother to read the applicable statues yourself, you would find that the only time this isn't true when it comes to KP is if pre-pubescent children are involved. That creates a presumption that the child is under 18.

Maybe you are conflating the civil and criminal issues here. For civil purposes, as I said in my first post, you are correct in that you need to have model releases & proof of age.

I saw this a few days ago to and wondered because I had seen most of the pics before.

The pics come from danish dating services like scor.dk, dating.dk it even has its waterwark on some of the pics.

They are clearly stolen and the girls might be 18 but the pics has been stolen.

Me too. JD Obenberger was at the AWE in LA. Talkek about that very subject. Burden of proof according to him is on you to prove they are 18 or older.

Besides doesn't matter. The press gets a hold of it and it's over. As far as innocent until proven guilty is concerned, not always. Especially since Herr Bush has been President.

All the DA has to do is tell the press that there were pictures of young girls on your hard drive that "Appear" to be underage. Once said, it's done.

So they can try you on obscenity charges either federal or local, add that comment to the press and get to say it to the jury too, then you are toast.

Don't depend on legal loopholes when dealing with porn and obscenity cases.

Some of those girls look very questionable. The problem would only arise if someone who knows one of the girls and she is under age then reports it to the poliice.
