I'm NOT an attorney, this is my opinion from seminars, trades shows, conversations with attorneys etc.
If it can be seen in the US, it will prob be considered published in the US. Kinda like mailing a video tape to PA from CA......
I think the Ausies ran something similar up the courts and said the same. Seen here - published here - we have jurisdiction - come on down and pay the price...
You can bet if our Justice department wants ya, they'll find away.
The jury is still out on many of these questions. In other words they haven't been settled by the courts yet (Common Law). OR congress hasn't pass a bill specific to the details brought up and even if it did and our President signed it, the law would still really have to be tested in the courts.
I really don't think it makes much difference where you registar a site. Where you host a site might mean something(?). If that's in the US, the feds have control over the ISP and thus the server. If the server and the site owner are outside the US, now you have more of a question at law and that's the part I think is still open for debate at law. If you're a US citizen living in the US and everything else is out of the country - the content came from here...

If you check around the web, you'll find a number of articles on the subject. Suggest you don't do that though - its depressing.
