    This is content theft to me

    I posted this to FMLTube in another thread, I thought it deserved a thread of its own. I do consider this content theft;

                  Since she hasn't gotten here yet ... she is using Tube Ace, which I also use for one of my sites ...

                  It's as simple as she assigned the video to the wrong site definition. That is also why those banners are there -- she assigned the video to the wrong sponsor.

                  Whether she did that on purpose I can't answer ... but that is why it goes to a different site and has different banners.

                          Thats a great explanation, I just wonder if I should spend time finding other examples on her site, that is seriously the very first one I clicked on

I am too lazy to do more but I am sure there is more, she was just talking about ripping people off if she felt they did her wrong so I checked....she needs to fix that site

                                          I'll be honest, if I found that with our content I would do one of the following;

                                          if our watermark was left intact, I would contact them to correct, if my watermark is removed or not visible (like on the second video) I would kill the account

                                              First and foremost, if you check your database, you'll see I am signed up under as an affiliate under your program. Second, its nothing more than a sponsor link error that was applied incorrectly that kept using BVBucks player.

                                              But hey, a simple email asking what was up would have worked better than trying to call me a thief now wouldn't it? No need to worry.

                                                  As you saw from your video, your watermark was there, the wrong player selected incorrectly. Kill the account if you wish, its not like your shit gets any clicks and fuck your face for the accusation.

                                                      just a simple selection of the wrong player since I am so used to selecting the first flv player in the list and it was a simple oversight after I added the BV player to the list. Thanks for explaining it to them until I arrived here.

                                                              I just did a check and there is no account with that e mail address but it doesn't matter. if you say you are an affiliate I certainly have no reason to doubt it.

                                                              I checked because you seemed like you would be quick to steal content if you felt you were wronged by a sponsor, and that is something that I strongly disagree with. It is never ok to do that. Like my mom always said '2 wrongs do not make a right'

                                                              There are other ways to solve your problems with sponsors that do not require you to go low, it is never ok for anyone to steal content no matter how much satisfaction it may seem to give.

                                                              I believe that when people keep their business honest others will respect that and good business follows

                                                                      Too much is being made out of the eye for an eye comment. As I have said before, that's only if I was 100% in the right and as a last resort.

                                                                      There is a simple report this video link on there that could have been used or a simple "hey this link doesnt match or is fucked up." Instead it seems like you went looking for a problem to call me out on when it was simple oversight of the wrong player selection. I do my best to make sure no illegal vidz end up on my site and I have far more respect for copyright than you think especially because I have mainstream projects published.

                                                                      My apologies to the sponsor as I thought it was the program owner that made the accusation. No worries either way, problem remedied.

                                                                              you're right, too much is being made out of your eye for an eye comment. But posting on boards is a double edge sword, if you are not exceptionally careful people can misunderstand the point you are making and base their decisions on those misunderstandings

                                                                              I went looking because whenever I have a link to a new tube site I wasn't aware of, I surf through it, checking it out for any of our content. Its a habit and I do it all the time. Your certainly didnt send off any red flags or anything

                                                                              1) what I saw, without having any information on you at all, qualified as content theft to me
                                                                              2) if it was a mistake it may show you to have your ducks in a row before posting the way you had in the earlier thread

                                                                              Of course you should be encouraged to post your opinion, but you came across almost as if you were supporting the poster versus the subject of his thread

Trust me, I am a stand up person and could have taken the easy way out and hosted a bunch of stolen content to drive the traffic and then sell it off (some bozo made an offer) but I prefer to remain honest and not commit career suicide so early in the biz. Even as an error it's prolly no more unethical than those that use sponsor's content to skim the click traffic which I do not do either. I am not willing to sell out for a quick buck. I will be successful or fail based on honest efforts even if my "looks like shit" as Killswitch said. The first thing once some revenue comes in is hiring someone to design it better.

                                                                                  I do allow user submissions and I go through them every couple days to check to make sure it does not violate copyrights. I don' hide behind DMCA but for user subs, I place the banners I think will interest other surfers. Now if that content belongs to someone else that was not the uploader, I am quick to remove it the moment I get the email.

                                                                                  In one month, I have managed to get my site up to 102K in Alexa USA. Not bad for remaining ethical and honest especially when doing things the wrong way would maybe have me higher and able to justify selling ad spots.

                                                                                  At least we got it figured out and notice I did not blame it on a rogue designer.
