                      Am afraid they are legal,DMCA law protect them.As longest they remove videos which you request to remove,they are compliant to law.

                          Safe harbor has it's limits, it is given only to those ISPs that do not have direct involvement in the infinging activity and no direct financial benefit from the act of infringement - both are false in the case of illegal tubes, recent events is the proof of that. They came here seeking for financial benefit from their infringing videos, thus they're not entitled to the safe harbor protection.

                          You can go ahead and sue them even without prior sending of DMCA TN, because they're 1) Not ISPs and 2) Not entitled to safe harbor protection even if they managed to convince the court they're ISPs.
