                              the network effect does not invalid the fair use right of backup, if it did system management servers would be illegal unless microsoft authorized the common image. for their os and software.

                              likewise the network effect does not invalidate timeshifting.

                              if you bought a right to the show, thru your cable bill timeshifting from a cloud is just as legal as timeshifting from a cassette.

                              the only person breaking the law would be the person didn't buy the show in the first place.
                              not the seeder (who is never giving away a working copy of the file)
                              not the tracker (who is only pointing out the seeder)
                              not the leacher (who has a fair use right to timeshift)

                              if that right was abolute then viacom would have had to accept redacted logs from youtube.

                              privacy rights are still supercede, you must prove guilt of something before you get to violate my privacy. In the case of canadian law which has clearly defined privacy requirements PIPEDA it even more insurmountable.

                              Given the fact that there would be no logical way you could claim that a movie completely changed in context by a brand new dialog could ever convince someone who wanted to see the orginal with correct dialog from watching your copy means their is no economic loss would mean even if you won you could get any damages. (stat gone because not wilful, real gone because you can't prove loss)

                              That assuming i lost.
                              the lack of a lost profit would in fact make a good arguement that it just like the downfall parody the completely different created by the new expression of dialog causes no economic damage and therefore meets the 4 conditions of fair use.

                                      Newsgroups and other little sharing sites from the past aren't even in the same league my friend. And yes it IS the problem the business is facing. I've been in online porn just about as long as anybody in this business and I have never seen anything like this. When entire members areas are ripped on torrent sites and tube sites are showing full scenes it becomes impossible to make money selling porn.

                                      That is the reason that production is so badly down, advertising is down, you can NOT sell a membership to a site that is already available for FREE in it's entirety.

                                      Bottom line is...the tide is starting to turn. Clowns like gideongallery now have to face the fact that the clock is ticking on piracy. Many have made quick money grabs, but that is coming to an end soon as well.

                                        I have no reason to believe this guy wasn't arrested, because the site is down and Eric from Remove Your Content is an honest guy.

                                        That being said, I guarantee you he wasn't arrested because of pirated porn on his site. Most likely it was Hollywood movies or Microsoft software and the like that did him in. The FBI doesn't give a rat's ass about porn copyrights, since the owners of the copyrights themselves usually can't be bothered to enforce them...

                                              Canadian laws do not apply here. But of course they have good proof before they knock on your door. They have not failed in one case yet, but for now the cases have been major infringements only.

                                              In the real world, rulings are usual logical and common sense. Do you have it? If your arguments or "precedence" was valid, everyone could just upload full movies with "parody subtitles" in any language, and point to "fair use". You know as well as me, that ruling will never happen, so leaving out your assumptions, the question about ruling will only be about how much damage you actually made.

                                                        Nothing like the millions of full scenes being stolen, viewed, and monetized by thieves every day, which is hurting the business big time.

                                                        Now as far as taking down what you are talking about...I've never tried. But if I found my stuff on there I'd put RYC on the case and get my stuff dmca'ed down. That site does have a hosting company and a registrar as well if they were to ignore the request.

                                                              Thing is ..those who own the biggest sites (whether forums, file hosting sites, newsgroups whatever it is) if their only objective is to spread warez around they should have something like this..and if they don't they wish they did.

                                                              RYC cannot search through a server and it isn't open to the public but those who have access to them can do damage on a very wide scale. There is 100's of BNCs for you to get to the real server when your going through a scene site. Is going to take a lot of investigation to get to the source and if you break the rules well you may get there quicker.

                                                              RYC that guy is a tool but he does what he does for people so I guess that is OK for people who pay him.

                                                              Most scene sites nowadays are in Europe or Asia, well the good ones of course. I can always start anywhere and say here is my scene site . That picture was from todays date. Tomorrow there will be so many folders on that site and so on and yes Brazzers content do get pirated on a wide scale as well.

                                                                        Bro, I must be totally lost. What I saw doesn't look like much of anything at all to me. Excuse my ignorance of "scene sites" But what is the point of that site? Looks almost like some guys private porn stash. Not real user friendly from what I saw in my brief look. It looks like one of my buddies private porn stash's from 1997. What is the deal on those kind of sites? And why would it be any threat to anybodies sales? Educate me and get me up to speed.

                                                                              No problem. Scene sites are what they are if you read from here (www.aboutthescene.com). The site like orlydb.com are "databases" of telling you what is out in the "scene". The scene is kind of like a community you probably have heard of but never got in to or would be hard to do so. Those who are in it and there is some who abuse their power to leak the very good rips of whatever it is porn.games.music to the Internet when you see on the internet the.porn.movie.here-weirdname on the end is mostly from a scene group and people recognize that.

                                                                              In other words scene sites work different from file hosting sites + torrents because they do not publicly give things out..those who are in the scene mostly leak stuff out to the sites above (torrents/filehosting/newsgroups etc) not everything from the scene gets leaked out but believe me everything that is media is ORGANIZED,LABELED, and properly put somewhere so people can find it easy.

                                                                              Why have a site like that ..the database so you have some information about the release and if your in the scene you can look it up. Is not a "central" server where people go and get stuff. The site aboutthescene.com should clear it up.

                                                                              However if you look through that site is not just porn is amongst a lot of things like xbox360 ps2 bluray dvdr xvid wii and the list goes on and if you go to the bottom of the page you will see "next page" there is always something being released EVERY minute (yes every minute) in all parts of the scene whether is from the USA (english) or Germany (german) or Asia (JPN KR etc etc) there is divisions all over. For example if a site like Twistys brings a copy out tomorrow expect a group to be all over that ..PROPERLY rip it and encode it to "scene standards" and put it out on the scene.

Yes everything is connected to a scene site in one form of another there isn't "ONE" person or "ONE" company ripping out everything for themselves or their sites.                                                                                     I think you might be offbase on the damage that site can do to sales. A much more potent surfer force is at work on surfer forums dedicated to stealing content and posting the scenes up on torrents and tube sites. WAY bigger traffic numbers, much more surfer friendly, and a much bigger "community". The warez site is just too "geeky" for most folks and doesn't even register as far as damaging the business. Probably just the way the warez guys would like to keep it too.

There is about 10-15 DVDs out everyday from the USA not including the other countries out there.

Millions of surfers have no idea about that site. They simply download a scene and go straight to the torrent site and upload it, then go the forum like pornbb and brag to their buddies and give the download url.

                                                                                                  The root of the problem doesn't lie in the warez sites. Those sites were around for forever and never hurt anything. The explosion in torrent and illegit tubes made everything nice and easy. And once it was discovered how to get through the "user uploaded" loophole it was a shitstorm. But the site you're talking about? It doesn't even register in this problem. Which is a GOOD thing.

                                                                                                    Well, on the bright side...at least gideongallery could possibly turn to warez sites now. Maybe he can invent a warez recorder like he did with his bit torrent recorder. Then he can use the warez sites to "time shift" on a "cloud" to his hearts content.
