                                                                  OK... so I don't recall anyone suing TMM when the security breach actually happened. That is serious real issue that to date has never been resolved in terms of who did it. But when someone reported the breach and said that members info was compromised (and can they prove it was not?), they sue the person who wrote it?

                                                                  And how about the time when everyones stats were compromised and programs stats were being posted here for all to see? Remember that little back door leak? Nobody sued TMM over that and honestly, it seemed pretty damaging for some programs who boasted big sales but had nill. Still, nobody sued them.

                                                                  If there was never a security breach, there would have not been a story written about it. Perhaps if more details were released regarding the release the story would not have been written in the first place.

                                                                  I like TMM and am happy with their product and support BUT I am disappointed in hearing this news. It seems to me time and efforts would have been better spent trying to give us a solid answer on the breach and how it happened in the first place and who is responsible for it.

                                                                                  It's been awhile now, and I can't remember which time this was... but I do remember a person attacking TMM, like accusing them of doing the hack or being at fault or maybe it was this person knew who it was.. Either way, I can't remember

                                                                                  If it was just straight out bashing and attacking TMM/NATS, I think 90% of that thread could have been sued... Some people went way off... That's why I think this is something different all together.

                                                                                  And "IF" I'm correct, I can understand what they are doing - maybe this is how they are trying to find out who it was. But if not, I would have to agree with you.

                                                                                      I agree. I remember the posts too and they were WAY out of line. TMM is doing the right thing here. Everyone can have opinions of course but when opinions are stated as "facts" and then repeated again and again in attempts to discredit a company or individual, without any regard whatsoever for the truth, thats when its time to bring it to a judge.

                                                                                              Yes it was a blood fest on the boards. I remember that. However, if you step back and look at things, IF personal data was at risk or someone from the inside caused it, and at the time how did anyone know it was not, there was just cause for the blood. After all, we only have TMM telling us there was no data leak, and I hope there was not, but if there was I honestly don't know if we would know about it or not.

                                                                                              I'm not sure how much in damages they are going to get from a blogger, but they could have gone after some much larger fish who were bad mouthing them on the boards if money is what they are after.

                                                                                                                          For those that dont know what Anti-SLAPP is, here is a short description from of all places Wikipedia....

                                                                                                                          The U.S. state of California enacted Code of Civil Procedure § 425.16 in 1992, a statute intended to prevent the misuse of litigation in SLAPP suits. It provides for a special motion which a defendant can file at the outset of a lawsuit to strike a complaint where the complaint arises from conduct that falls within the rights of petition or free speech. The statute expressly applies to any writing or speech made in connection with an issue under consideration or review by a legislative, executive, or judicial proceeding, or any other official proceeding authorized by law, but there is no requirement that the writing or speech be promulgated directly to the official body. It also applies to speech in a public forum about an issue of public interest and to any other petition or speech conduct about an issue of public interest.

                                                                                                                          To win an anti-SLAPP motion, the defendant must first show that the lawsuit is based on constitutionally protected activity. Then, the burden shifts to the plaintiff, to affirmatively present evidence to show that they have a reasonable probability of prevailing on the action. The filing of an anti-SLAPP motion stays all discovery.
