                    AVN would have a lot to prove to a jury to even get a little sympathy, and it'll be nothing compared to what they'd have to do in order to get the industries sympathy. The only thing I can imagine is that they are hoping for a settlement, and that it never even goes to trial.

                              I am pretty sure, unless you are an executive with the company, they can't prevent you from going to work for a competitor in California..although I could be wrong. Defining an "Executive" is another tricky situation...just cause your title has the word executive in it doesn't necessarily make you an exec under the letter of the law. Now, I'm not an attorney so my comments are just my own opinions but I really doubt AVN has any leg to stand on here. I have gone through similar circumstances with past employees and customer lists, and so-called "trade secrets" with a negative outcome for me as the company owner. What I've found over the years is that Judges tend to look at employees as the "little" guy almost without exception which generally leads to them finding in favor of the employee.

                              Now if were talking about "trade secrets" I think in this industry they are few and far between. Besides, you and I have been in this biz long enough to see that most of the industry was built on copying each others ideas in some form or another. But specifically to the Ad and online publishing arena I have a very hard time believing that AVN has a lock on any trade secrets that anyone with half a brain and the will to search Google can't uncover on their own. Again this is just my own opinion.

                                  but that aside...my opinions on the other items still stand...I think it's an uphill battle
