          Even though it wont shut the Pirate Bay down, it sets a nice precedent. All these half assed torrent sites that dont have as deep a pockets as the Pirate Bay wont be able to recover after getting their asses sued out of existence. Every little torrent site operator out there just dropped a little nugget in their panties today. The Pirate Bays days are numbered.

          Keep the warez where it belongs, in the scene. Torrents are to warez what AOL is to the internet.

                Not surpised - piratebay.org have already been shut down in Denmark. This is the message you get, if you try to access piratebay.org in Denmark:

                The City Court of Copenhagen delievered a ruling according to which Tele2 A/S is obligated to prevent its customer.s access to www.allofmp3.com and www.mp3sparks.com and www.thepiratebay.org. The sites are - according to the Danish branch of IFPI - provider of illegal copies of protected music.

                It is expected that all Internet Service Providers in Denmark will follow Tele2.

                Tele2 A/S has not registered your visit to this page.
                Of course danes can still access piratebay.org, if they change their dns settings, but this is how the problem with thieves will be dealt with. If you can´t shut them down in their home country, then shut them out of your own country

                    Today I am ashamed of Swedish courts and justice system. 1 year in jail AND 30 mil Swedish crowns in damages while pedophiles and rapists receive 6 months and they victims hardly any money.

                    But this will never stand and will be reversed in higher court

                                      what this verdict says is that it's holding individuals accountable for making available such a site, who's sole purpose is to distribute copyrighted material. My question is, does Sweden law hold up as legal precedence? Holding the Individuals accountable is right. Rather then the site. the site is a tool, the individuals constructed the tool and made it available to the masses for the sole purpose of distributing copyrighted material illegally.

                                      the same can be true of tube sites. Rather the site isn't illegal but the manner in which it makes the feeds available is. and the person or persons that have made it available are committing a criminal act.


                                      u all remember illegal cable de-scramblers? the box isn't illegal, niether is the TV u use to watch it on. However, creating the box or chip is. selling the box is.

                                      the same with programmable football cards, remember those for satellite dishes? same thing again. You'r not a criminal for owning a dish with an unactivated card. however the criminals are the ones reprogramming the cards, since they acted with the intent of creating a tool to steal copyrighted materials.

                                      Now here's the catch 22 i see. With this line of thinking, users would also be deamed criminals, since they used this service for the sole purpose of downloading or viewing copyrighted material ...

                                              let other crooks they can catch get away.

                                              Further, count the number of victims in the case.
                                              TPB has 1000's of victims of copyright theft.

                                              The magitude of TPB theft deserves some attention in the form of sentencing.

                                                          The technical aspect of this case is not what's important and they would easily go free if the court only took the technical aspects (how bit-torrent works) into consideration but that's not how it works in a court of law.

                                                          It's their intent of the website and nothing else. They have been found guilty because of the intent. And their intent is quite obvious - to make it easy for people to share copyrighted materials, and it's not really to their advantage the way they've handled the emails from all the different companies. It makes their intent even more obvious.

                                                            It was stated above that they made 1.2 million a year. That's WAY less than we made on our TGP's each year. And trust me, 1.2 million a year sounds good...but it ain't a lot of money. Especially when you have 3 or 4 partners to divide up whatever is left after paying the bills.

                                                            So if their "dreams" are to be lower middle class and in debt for big fines imposed (over 3 million so far) and having their freedom taken away for a year and with a business model that can't survive...then yeah, they are living their dreams.

                                                            Smart thing to do would be to make TBP legit NOW while it has a ton of traffic and sell it for an astronomical fee to a large company looking to up it's internet presence.

                                                                        robbie they were convicted base on the "unrefuted" claim that linking to copyright material from a bbs was a relevant example that infered liablity. The problem was that this point was brought up in the closing arguements of the procecution and not in the testimony where it could be refuted.

                                                                        Given the fact that unlike a link to a complete working copy of the file (ala bbs example) is not the same thing as point to a torrent file which is a session where no complete copy is transmitted (only pieces) will makes a huge difference.

                                                                        this is the one case that needs to be knocked down to make torrents just as legal as a vcr WORLD WIDE. Once that precedent is gone, there is no criminal act and therefore no intent to commit a criminal act.

                                                                          I think you're totally confused and have it all wrong. This was not a copyright civil case, this was a criminal case. Individual companies can not bring criminal cases willy nilly against the owners. They will need to file in civil court. At least that's how it works over here.

                                                                            I read that lawyers are looking into whether this case has implications for Google, which also simply links to copyrighted material, which is all TPB did as well.

                                                                            But I guess the judge said that the biggest factor was that TPB was clearly a commercial venture created to make money. If they did it for free, they probably would have been fine.

                                                                                              This could be really good news. As far as more companies going after them. They would in the US as now that they were found guilty of a criminal act it is easier to prove a civil case. Remember OJ? and he was found innocent and still lost the civil case.

                                                                                                    Smart thing to do would be to make TBP legit NOW while it has a ton of traffic and sell it for an astronomical fee to a large company looking to up it's internet presence.
                                                                                                    What other options do they have? I mean they are not talented enough to create something on their own. They need to ride on the coattails of those who do have talent. Stealing is the business of those who are not smart enough to make it in the real world. While their situation sucks, the other option for talentless people like this are to work at a McDonalds or something.

                                                                                                      Google's business doesn't revolve around piracy, The Pirate Bay's does. It's like comparing a drug dealer to a doctor who may have been tricked into prescribing pain killers to an addict.
