          Well, dipshit should have answered the questions. I'm sure he was pissed that he was being questioned, but there is such a drug problem in Mexico you can understand how sometimes they would be suspicious. I understand him not wanting them to search his car because he has done nothing wrong, but there is nothing wrong with them asking questions of him. The minute he refused to answer the questions he looked suspicious and they are going to find a way to look in his car.

          That said, he should have never been beat like he was and treated like he was. If they really suspected that he had something in the car they should have told him they were taking him out of the car and if he refused or resisted they would taze him. If he then refused/resisted I can see why they would use force, but still not like they did. It sounds like he wasn't fighting back so there was no need to break the windows and kick his ass like they did.

          I would assume the tapes of this will become public and the guys that overstepped their authority will be dealt with.

          Being a border patrol guard is a rough job, but they went way too far with this dude. (Assuming everything he is saying is true)

              Sucks he got beat if he really didn't do anything, but watching his preaching vids he certainly seems like a nut and might have been too confrontational with the fuzz.

              Not that you should roll over for the cops but certain people seem to know how and want to push buttons and get themselves into fucked up situations, and listening to him preach about "if Obama is half white and half black, I'm going to pick the white half" makes me wonder about this guy.

                They can ask him anything they want, but they have no legal right to make him answer and they have no right to detain him unless there is probable cause. Not answering questions is not probable cause as far as the law is concerned.

                He was not passing across the border. This is an INTERNAL checkpoint.

                    i only read the first bit of this.. but they literally would have to have exact description of him blazing over the mexican border to be justified in strip-searching him and his car.

                    in vancouver, i would be legally able to walk away from a police officer, providing he doesn't give me justifiable reason for me to stay and answer his questions.

                    that being said, i'd answer the questions.

                      so... right away you have some basic info... he was totally uncooperative with border patrol agents, uncooperative with highway patrol, argumentative and basically acting like an idiot.

                      all he had to do was smile and be human and let them do their jobs and drive home. instead... he went a different route. sucked for him. but its direct the result of his actions.

                        To those of you who dont understand: The "border patrol" check point WAS NOT NEAR THE BORDER.

                        I have these around where I live over 150 miles from any border.

                        The border patrol has all the right to ask him questions, he has all the right to not answer without punishment.

                              So when dealing with law enforcement people should always smile, answer all questions and allow officers to search anything they want to and if people do not do this they deserve to be pummeled for not being human?

                                  You are 100% correct. They can ask him anything they want and he has every right not to answer them. But not answering their questions will make them suspicious. When they get suspicious they want to look in the car. I'm sure they could argue that their probable cause was that he was being combative and that they suspected he was smuggling something.

                                  To me it comes down to location. If you are diving down the street in your neighborhood and the cops pull you over and start giving you hell just because they are bored they shouldn't be allowed to do that and you should be allowed to not answer them and not be searched. You are not in suspicious area or acting in a suspicious way. However, they don't have checkpoints just for the fun of it. If you are in an area where there is a checkpoint it is because bad things tend to happen in that area. So there is already a heightened sense of suspicion when you are in that area. It is kind of like if you are just hanging out on a street that is know primarily for being a drug dealing area or a prostitution area, chances are you are not there just to enjoy some fresh air. So I can see why when they questioned him and he refused to answer they decided he was acting suspiciously.

                                        No people should asses their situation and act accordingly. If I am in an area that is known for having a high crime rate and is frequented by drug dealers and the cops come up and start to talk to me, I should be able to understand that by hanging out in a high crime area I am a little suspicious. If I am truly doing nothing wrong, then I have nothing to worry about. If I am walking down the street near my house in the suburbs where there is very little crime and just out for an afternoon stroll walking my dog then it would seem suspect for a cop to come up to me and start asking me a bunch of questions.

                                        Again, he was going through a checkpoint. Those are just there to count the number of cars that go through them, they are there for a reason. If I am going somewhere (or coming back from somewhere) where there is a checkpoint in place I should understand that they are looking for people acting a certain way and it is not unreasonable for them to ask me a few questions. If I decide to be combative and not answer them, then I should understand that they might start getting suspicious.

                                          yeah.. thats how it works. police have requests, you comply, be polite and let them do their job. you are probably very young and can't understand this. after getting in trouble a few times just because you wanted to "be right", you'll understand that the whole thing could have been avoided by not being an asshole and that your trying to win what is going to be a losing argument 100% of the time.

                                          as you get a little older, you'll be thoroughly dismayed that anyone would be a dick to border patrol and highway patrol and refuse each and every request from them and you will be using this as an example to your kids of how "not to act"

                                            And if I am walking down my neighborhood street and a cop just pulls over and starts grilling me I can walk away from him and unless he has a very good reason to stop me he can't do anything.

                                            I have said it several times now. This was a checkpoint. a checkpoint is in place for a reason. They are trying to catch criminals. If you go to an area where they have a checkpoint that they are using to try and catch criminals and you start to act like you are hiding something people are going to get suspicious of you quickly.

                                            So should anyone who pulls up to this checkpoint be able to hold up a sign to the window saying, "I won't answer any questions." just be allowed to go on through no questions asked?
