A good lawyer will remind the jury that their emotions and beliefs cannot come into consideration in trying the case. They must only listen to the facts, how they apply to the law and make their decision based solely on them.When you are dealing with a court system and jury, you are dealing with emotions and cultural beliefs. I am saying that when the case ends up in front of whoever is in the court, they are going to profile TeenRevenue in their minds immediately as an undercover underage teen producer, and this is a huge disadvantage to TeenRevenue. Court cases and good lawyers play on emotional factors to pursue the jury and get people away with murder. This is not rocket science....
You have to think, a lot of people are already against porn in our evangelist society which most likely make up the jury/judge. What do you think their thoughts would be on teen porn? I don't think there has ever been a court case where a teen content producer was not being sued or shut down. People do not like the words "teen" + "porn" put together. The jury/judge will immediately look down upon TeenRevenue as a company that exploits young girl, and now is standing in court trying to find justice. A Judge cannot be biased or base his judgments on his personal beliefs or emotions. He must stay within the guidelines of the law. You say a Judge might have a daughter and take personal offense to the litigants. If that were possible why wouldn't they make it personal with all teen rapists, murders and whatever else comes through the court room.
A good lawyer could have removed any Juror or Judge that let's his personal feeling affect the caseComment

This may be what happens. And remember that Redtube was/is for sale and potential buyers received info such as revenues directly from Redtube owners. If TR has this info, they know the money that Redtube supposedly generates, and therefore know what kind of money they can obtained from Redtube.
It'll be interesting to see how/if TR is able to show directly how Redtube caused them to have to sell their properties for a lower amount than they wanted to, and how Redtube has directly hurt their sales, since damages are being based on these things.
For those saying the judges and juries are going to scoff at the case because it involves smut, that's totally untrue.
I think those of us who have been around awhile have a good idea which companies/individuals are behind Redtube, even though it's difficult to know for a fact. Their entire setup has been well orchestrated to insulate the indentity of the ownership, hence their operation out of Hong Kong. Redtube makes money and even if it didn't, those behind it have money. If the Redtube owners lose Redtube it's not going to break them financially.Comment

This industry is increasingly short-sighted. Content producers are more than willing to license their full-length movies to tubes, more and more sponsors are promoting their own sites on illegal tubes (while affiliates turn a blind eye for hefty PPS), and sponsors keep pushing out longer and longer clips for affiliate use so that average Joe webmaster feels like he can compete with the real tubes.

Only reason I did not outright say which law in past posts is that this one is a pandora's box of legal fuck yous and I have already seen how this industry likes to exploit silly ass laws to their benefit.
PS if redtube settles this case they are instantly fucked under the same law.
PPS for instance if I filed because I am disabled there are special clauses and damages just for that, along with others.
17200 cases are just straight up fucked up. Combine a 17200 case with the California's private attorney general provisions and then it becomes a legal gold mine.Comment

I personally don't think the Torrents are the problem. Torrent users are advanced users and anyone using those, probably won't pay for porn. They will go to IRC, P2P or whatever.
