        Redtube are in Hong Kong. They have to come over and get a lawyer, all costs money and in todays hard times it might not be worth it. And it's not just for one court appearance, CA courts have a habit of stringing cases out.

                    interesting tact they are taking - i don't think anybody can comment on the merits of such a suit without knowing the California law they are using and without doing a search on cases which are relevant to this suit. i'd love it if there's some merit to their complaint.

                    So in California if I had a hot dog stand and was selling hot dogs for a dollar and some guy decided to open a hot dog stand on the opposite corner from me and give them away for free or a nickel and destroyed my business I'd have legal cause to sue them for the financial damage they caused me?

                    so this is now two lawsuits TR has initiated against RedTube and its advertisers? One from Paolo and now one from Kevin? They are partners in TeenRevenue?

                    why RedTube? they can't even find the owner of it it sounds like and who knows if they ever will - when you have Pornhub based in Canada and lots of people who know for a fact who owns it?

                      I have no clue, but just to forward the discussion, I bet the law was some kind of response to foreign companies dumping super cheap goods at a loss into the American market, which was pretty popular a while back if I remember in certain sectors. Some Japanese car makers were even accused of doing this in the '80s.

                        Let's break this case down psychologically, and apply some common sense factors on how it will play out in the long run. The judge is first and foremost a human being, just like you and me. This judge most likely has a teen daughter or a teen grand daughter.. When he reads the case, and sees a name like TeenRevenue.com, what do you think his conscious and human instincts will say? Have any of you gone to TeenRevenue.com? they advertise short of lolita (little this, little that). The whole marketing scheme is screaming "these girls are not underage, but we want you to think and feel that they are underage so that you can fantasize about fucking little girls, so please signup". Sorry to put it that way, but anyone with half a brain in marketing can see the entire strategy here.

                        Do you think the judge, or anyone in court would want to see a single dollar go and feed a a website like TeenRevenue?? I would not be surprised at all, if initially they do a more extensive investigation into TeenRevenue itself than RedTube, and don't be surprised if RedTube would not be trying to find and exploit something about TeenRevenue in this case. I know I would if RedTube was mine.

                        with all that said, this case is going to go to court, and the judge is going to look at, as this teen promoting porn site wants to sue another porn site over loss of "sin" money. Do not think for a second that the judges are liberal and all that bullshit crap you think. Most judges are very religious and carry on a conservative point of view, even if they are democrats when it comes to voting in elections.

                        To them, we are the scum and low lives of this earth, and the faster they can shut us all out, the better it is for the goverment and all of society. Everytime we bring porn into goverment halls, we bring more attention and first hand knowledge to the people in the goverment about how we thrive and operate. We give them more ideas on how to shut us down, and definitely good reasons to do so.

                        In conclusion, and in my humble opinion, this case is going to be treated like two dirty dogs fighting each other, and no one is going to care about that shit, but the lawyers and the owners of such websites, everyone else in court is going to look at all of these lawyers and parties as scum bags who should not exist in the first place.

                        Agree or not, you know it's the honest truth.

                          i don't know what their goal is with these suits, whether they think they have a reasonable chance of winning them, whether they are hoping for cash settlements or just frustrated enough with this tube shit that they are doing it to just to be a pain in the ass to the companies.

                            i highly doubt that the purpose of the lawsuits is the goodwill they will build with webmasters for taking on the evil tube site owners. but as a spinoff benefit it's not bad. i'm rooting for them.

                                        It has been the industry standard to give "loss leader" content away to entice sales since it has started, that is why there have always been free sites and pay sites.

                                        If the suit were about copyright infringement, I would say support it with all you have.

                                        From a legal standpoint tubes are simply another form of free site, which like so many things over the years have grown to the point that they hurt the overall business. (more free porn always equals less sales)

                                        All of you free site webmasters should think long and hard about what it is this suit actually means should TR win.

                                        Personally I would love to see the amount of free porn available go back to 1998 levels where every free site had the same 20 or 30 pics from the $99 ZMaster cd. (insert a Bop from PK here) But we all know that is not going to happen.

                                          I was thinking if they could win this, what's next, sue The Hun?

                                          Then I realized that most of the large free sites up until now were just aggregators of links, who didn't really publish or host much content themselves. So it would be next to impossible to use the same tactic against them.....you may as well try to sue google for helping people find free porn.

                                          So if they win, that's a mother fucking HUGE if, the precedent would likely only affect tube sites.

                                          That being said, I have a better chance of tapping J-Lo from behind while Jennifer Garner licks my balls than TR has of winning this case.

                                                  Remember that even if RedTube presents that about TeenRevenue as argument is not valid because the case here is TeenRevenue suing RedTube for content stealing. If somebody wants to sue TeenRevenue because of what you say they should present a new different case and should not be put as in the same case, or at least should not be considered as a valid argument for the case.

                                                    RedTube is being accused of steal TeenRevenue content. So basically it's asumible that they're stealing young content. The judge will not look that good either.

                                                            Whether or not the content on RT is from TR is irrelevant, they are hosting and displaying content from other producers, content they don't own. They might be asked to prove it user uploaded.

                                                            MIS ridiculous argument. If Redtube were a Youtube is would your post some validity. They are porn both merchants. The judge also might have a son surfing the Internet and shocked what he can see for free.

                                                                Both arguments are so flawed it's a joke. If Redtube turns up in court they will be asked if they uploaded the stolen content or it was user uploaded, they will then be asked to prove it.

                                                                They will also be asked about 2257 and what measures they take to ensure the content is legal. The fact that RT is full of content that don't own, might upload themselves or have uploaded, is also full of content illegal in the US is going to sway any judge or jury. You can bet TR lawyers have been videoing RT and it's content for months.

                                                                          The California Unfair Competition Law is very broad - if anything, even the fact that a tube site is distributing watermarked videos without authorization should be enough, as the owners of the video have, at the minimum, common law trademark protection, at least for US based producers - and if the trademark is state or federally registered, all the better.

Then of course everyone turns into cheerleaders until this is over - if I were RedTube, I would drag out litigation as long as possible and reap the benefits because they probably won't be sued again until it's over...TR apparently is the only one with balls plus it is of course a nice marketing boost too as everyone's talking about them now.

I mean with tubes around, from my perspective as a surfer vs. someone in adult, there's absolutely no reason to pay for porn...none whatsoever, and that's not even taking into account cross sales etc.

The music and the mainstream movie industry as a whole is doing just fine even with so much free music on radio, tv, and the internet.

                                                                                      Tube sites consumption is an opportunity to make lots of money, problem is none of these people here have a business degree. All they know how to do is pay some crack whore to suck their dick on camera, then think they can charge 39.99 a month for people to see other crack whores do the same thing, while they smoke or shoot up the profit.

The problem with your idea is for 8 years the belief was the surfer would buy anything and all that was needed was more traffic. Even as ratios got worse the solution was more traffic. Today as traffic falls, ratios get worse people still believe the solution is to send more traffic.

                                                                                                As if the idea of converting more of what you have is some crazy idea.

                                                                                                  When you are dealing with a court system and jury, you are dealing with emotions and cultural beliefs. I am saying that when the case ends up in front of whoever is in the court, they are going to profile TeenRevenue in their minds immediately as an undercover underage teen producer, and this is a huge disadvantage to TeenRevenue. Court cases and good lawyers play on emotional factors to pursue the jury and get people away with murder. This is not rocket science....

                                                                                                  You have to think, a lot of people are already against porn in our evangelist society which most likely make up the jury/judge. What do you think their thoughts would be on teen porn? I don't think there has ever been a court case where a teen content producer was not being sued or shut down. People do not like the words "teen" + "porn" put together. The jury/judge will immediately look down upon TeenRevenue as a company that exploits young girl, and now is standing in court trying to find justice. Wether this is the actual legal arguement or not, emotions don't have to follow paper.. Decisions are based on emotions. And mark my words, RedTube WILL win this case, and not only that, but when redtube wins, no one else can sue taking the same path as TeenRevenue and then kiss that one chance good bye. If this was PlayBoy suing RedTube, they would have a much stronger presence and impression on the court.
