    You?re exactly right. But in the given scenario we?re not talking about someone who?s specifically searching for your content exactly. The surfer doing that is a good potential customer (if they can?t find your entire site ripped on that torrent site). I?m talking about the guy who?s just browsing for porn in general, and has no preference for your content vs the other guys. The chances of him buying anything were never great to begin with.

      SOME of them were that way. But I didn't make everything I did over the last dozen years because so many people were never gonna buy a membership.

      And you're right about the guys with general porn. I would not want to be in the shoes of all those site owners whose paysites consist of generalized hardcore using those same dozen or so models out of L.A. All of this content theft has destroyed their future.

      But for claudia-marie.com it really is guys specifically searching for her. And not all of the ones specifically searching for her are potential "good" customers. A quick look at surfer forums when I search the web for her tells me that quickly. The forums are full of page after page of surfers listing and uploading stolen scenes from their favorite model.

      The key is to protect your stuff, police your stuff, and then stay in control of what the tubes and torrents have to offer.

      At least that will work for Claudia-Marie.Com

      I have absolutely no answer for all those big "mega sites" that one week feature Puma Swede in pigtails as a "teen" and the next week have her in eyeglasses with her hair in a bun and call her a "milf"

      Unless something changes, that entire site model is doomed.

        Yes, but do those guys fit into the same category of surfer that you described above? If they?re repeatedly signing up to your sites then I?m betting not.
        I guess you never look at my sites then.. Ya they all fit the same bill. I shoot teen and thats pretty much it these days. Now they can just do a search on all the new sites and look at whjat ever members stuff they want.

        We shoot edit design and market our own stuff.... I know my customer..

              Yeah, they're pushing the sales pitch now, while they obviously only created a huge amount of traffic that only burns an assload of bandwith.

              Another reason why tube8 gains on popularity.

                  Yeah, Redtube has been pretty much legit for nearly a year now. Not sure why so many GFY'ers hold it up as the model illegal site, sort of exposes them as being out of touch.

                    Yes but what was left out is this. In the past before tubes and tgps like today the guy who buys porn sometimes would do so because he never got free stuff worth anything much so we teased him into a membership. Then he downloaded content and would watch his downloads for a while until he got bored and then would buy something else. Now he does not have to pay or download just watch it stream full screen with the lastest flash players 20 minutes plus long clips from every stolen members areas. Like Red Tube started out doing.. Tube 8 also..

                    So you see the guy who was maybe or maybe not is just plain NOT.. Been selling memberships for over 10 years and everytime there was more givin to surfers the ratios went down.. Ask anyone with at least 10 years selling.. they will tell you the same

                          Btw. this whole situation, regular porn getting to shitter - that's a huge competitive advantage for me.

                          While at the moment when most are whining I know our stuff converts with GENERAL audience at 1:101 for the whole 2009 and BELOW 1:500 for over a year from a LEGAL TUBE SITE with full length licensed video in it.

They stopped accepting random uploads sometime around the summer '08, or at least that's when I noticed it as I was uploading watermarked videos till then (I owned the rights). They required a sponsor style sign up at that point forward.

                                            I don't exactly see how the host or redtubes advertisors would be dragged into this lawsuit. Considaring redtube sells its own memberships the unfair competition is between redtube and the other media produces. Not really seeing where choopa is being dragged into this unless they have interest in redtube.

                                                  LOS ANGELES — Kevin Cammarata’s $40 million lawsuit against operators of RedTube may have legs.

                                                  The online adult entrepreneur, who is founder of numerous websites and affiliate programs, including TeenRevenue, claims in a suit filed last month that streaming video site RedTube has unlawfully offered free movies as loss leaders in an attempt to crush the competion.

                                                  In his antitrust suit, Cammarata is seeking to have RedTube shut down.

                                                  “Now that consumers have the ability to watch high-quality adult videos for free on RedTube.com, fewer are making the choice to pay other adult website proprietors for the same or similar content,” the suit said.

                                                  Cammarata’s attorney, Jay Spillane, told XBIZ that because of these loss leaders streamed over RedTube, Cammarata has faced a substantial loss of customers and revenue, leading him to sell his business at an unfavorable price.

                                                  “Tube sites have done injury to the business,” Spillane said. “We feel RedTube and other sites like them are crowding out competition when it comes to the online adult business.”

                                                  RedTube is currently No. 45 on the Alexa traffic ranking scale but has cloaked itself in obscurity, according to Spillane.

                                                  Spillane told XBIZ that his firm so far has narrowed down companies named as defendants and has identified a Hong Kong company as the owner or operator of RedTube. That company does business as Bright Imperial Limited and is located on the 28th floor of a high-rise in the Wachai district of Hong Kong.

                                                  The suit, filed at Los Angeles Superior Court, also names as defendants Choopa, which hosts RedTube from Sayreville, N.J., as well as numerous blue-chip adult companies that advertise on the tube site.

                                                  Those advertisers that also are named include Bangbros.com; Utherverse, which owns RedLightCenter; Generation Financial, which owns Videosz.com; Fling.com; SexSearch; Lalib Limitada, which owns LiveJasmin.com; FriendFinder Networks and Brazzers.

                                                  Spillane said that the suit has been amended four times only because it has been difficult finding the real owners of the advertisements, which border the tube site that now offers some content that surfers can purchase.

                                                  “Of late, RedTube is offering a premium version, where consumers pay extra,” he said. “But if you look, you’ll see that they still offer 10,000 free videos.”

                                                  Spillane said that many of his online adult clients have been furious over the losses incurred by RedTube and other similar sites, and his firm had been seeking a bulletproof strategy.

                                                  “We worked on several legal theories,” he said, “but the one that seemed most reasonable was unfair competition. We worked on the possibility of copyright infringement but there are technical problems with that.”

                                                  Spillone noted that Cammarata, of Calabasas, Calif., said that TeenRevenue videos have been streamed on RedTube without the company's permission.

                                                  The suit, which makes claims for below-cost competition, loss leaders and unfair competition, among others, seeks $10 million in actual damages and $30 million in treble damages.

                                                  It also seeks a permanent restraining order against RedTube.

                                                  XBIZ was unable to reach operators of RedTube by post time.

                                                      I don't really get this document. It looks like a partial four pages of a guy trying to say he's not liable cause it's not him. I had more pages on me for a crummy 18 months sentence.

                                                      What's the real story in layman's terms?
