This is the point so few get.
There is no legal avenue and never will be to getting rid of Tubes.
If you disagree point out how and I will reply.
Even if they change DMCA to enforce the repeat offending site to prove it was uploaded be an outside user and you can find him and sue him. Even if they pass a law in every country in the world to make Internet piracy a real offense and they enforced it. Tubes will still stay and still take your customers.
I wish it was not so, but it is and always will be.
Because if this impossible dream became a reality Tubes would still be here. If we don't change the business model of what we sell.
Some sites will still support full scene Tube sites. Others will give the Tube site owners all the 4, 5, 6 or what ever length scene they ask for. And some will host the scenes as well, so the Tube can sell dating and cam sites. A struggling site or sponsor might decide to turn their site into a Tube site with all their legal content, keep their existing join links and start harvesting traffic and bookmarkers. They can add the dating and cam adverts before or after they inform their affiliates. They are not worried about upsetting people, they have made the move to the dark side.
And customers and surfers will still flock to them.
And don't think we will. We make good money still from the paysites and content stores and do not see it getting worse. In fact it's been getting better the last few months.

That is illegal by law by default.
If someone uploads copyrighted content - and I know they most likely have monkeys uploading new ripped video almost every hour to keep it updated, you have DMCA to cover it.
They even upload ripped DVD's without watermarks or buy cheap licenses from monkey producers, who don't understand that a give away license not only devaluates the content they just sold, but that it also devaluates any other content they will ever produce or any other content in general, that if fucks up the overall general demand for porn.
Unfortunately, retardation and idiocy in this "industry" is a safe bet.

Myspace/Facebook struggle to make profits, as does YouTube. Twitter and Digg are losing millions of dollars a year. Traffic doesn't always mean profits.
Nonetheless, just because you feel someone isn't utilizing their product to your liking certainly doesn't mean they should have it stolen from them. I think it's silly that Amazon sells their Kindle for so much right now and think they'd do better lowering the price a lot and making their money off digital book sales in the future. so the cost allocation to break even is WAY lower.
it has taken us 2 years worth of testing to put together 121 things you need to save a cancelled tv show using bit torrent.
The funny thing is each one of those thing was tested with adult content. (i was the guy who did the testing).
While you have to do all 121 to even have a shot of saving a cancelled show, you only have to do a tiny fraction of those things to recover your loses in the case of adult.

A large studio that had their girls on many of the biggest and medium size sites has reported a 40% drop in revenue and the girls who turn up for castings who are or have worked in the Cams side complain about the money. This industry was good, over grew itself and now is suffering and unlike paysites you can't ignore the content. It costs you money and if you redirect money from the girls to the affiliates and adverts to get more traffic the girls leave. Dating is new, but how long will it be able to fund the Tubes? Logic tells me that if someone meets a person they like they come out of the dating game. If they don't find a partner how long will they keep spending money to get nothing? Yes there are some guys and a few girls who are looking for fast sex, but you can't run AFF on them.

Advertising on a Tube is the opposite. The looker needs a bit of free entertainment, the odds on him wanting the product next to the free entertainment are minute. Comparing a click able advert that can track and evaluate traffic with TV ads is another example of peoples ignorance about advertising.

Most of the Pirating sites exist on selling something, adverts is one and maybe there are other ways. But we are now 6 months into a recession and it's going to get worse. A lot of people are going to suffer and the Pirate sites will suffer worse than most. Especially in Adult.
Paysites can cut their budgets, traffic, content, staff, development. Tube sites can't. I suspect most of them are run on a tight budget and survive on the 1 in a 1,000 who buy. It could be higher or lower than that and yes it's a guess. But he once said that he was getting 1-300 conversions. And I assume he means on people clicking on an advert. How many times does a scene get viewed before an advert gets clicked on?
More people with less money are hitting the Tube sites. Web cam is not the money maker it was and Dating will suffer in these hard times. I suspect they will be getting more traffic and less sales in the future. Higher bills, less sales equals problems.
I'm not throwing in the towel yet.

i have tested 231 things to monetize the bittorrent distribution of adult content. 61 worked. another 32 won't work with adult content (given it nature) but will work with non adult content irregardless if it is pushed by the establishment the last 29 will only work with an established push.

technology is starting to solve the bandwidth problems. there is multiple project to make a flash style player that will play a torrent file in real time. As a result the cost of serving the file to 100 people is the same cost as serving it to 1.

They use the tube with the intent of stealing the studios money and time invested that it takes to produce a title for his own behalf... Look, there?s no doubt the tubes and file shares are costing people sales. I think they hurt the most with the surfer that?s looking for your content (or a particular type of content) and is willing to pay for it, IF (and only if) they can?t find it on tubes and fileshare. You take away the tubes and file shares with this kind of surfer and that?s a conversion. However, if they weren?t looking for your content specifically, then there?s a high probability that you wouldn?t have gotten the sale anyways.
But there are different types of surfers. You have some surfers that will never pay for porn, period? end of story (been that way since the beginning). But there are some that will pay for porn, and still do despite tubes and everything else. You also have variations of everything else in between. And it seems to me like everyone always focuses on the surfer that is the LEAST likely to pay for anything, and then bitches and whines about how they have no chance at ever converting them because of tubes, file shares, etc.

This piracy and tube debate has many sides. People always talk like these theives are going to convert to sales. They're not.
Just as I have said in other threads. Not a single RL person I know, or ask, knows how to use all these illegal or file sharing things. Other than tubes. Yes but what was left out is this. In the past before tubes and tgps like today the guy who buys porn sometimes would do so because he never got free stuff worth anything much so we teased him into a membership. Then he downloaded content and would watch his downloads for a while until he got bored and then would buy something else. Now he does not have to pay or download just watch it stream full screen with the lastest flash players 20 minutes plus long clips from every stolen members areas. Like Red Tube started out doing.. Tube 8 also..
So you see the guy who was maybe or maybe not is just plain NOT.. Been selling memberships for over 10 years and everytime there was more givin to surfers the ratios went down.. Yes but what was left out is this. In the past before tubes and tgps like today the guy who buys porn sometimes would do so because he never got free stuff worth anything much so we teased him into a membership. Then he downloaded content and would watch his downloads for a while until he got bored and then would buy something else. Now he does not have to pay or download just watch it stream full screen with the lastest flash players 20 minutes plus long clips from every stolen members areas. Like Red Tube started out doing.. Tube 8 also..
So you see the guy who was maybe or maybe not is just plain NOT.. Been selling memberships for over 10 years and everytime there was more givin to surfers the ratios went down.. Ask anyone with at least 10 years selling.. they will tell you the same

If sponsors can't cross sell affiliates traffic off their sites why can affiliates cross sell using sponsors content? I know it was always done on TGP sites, but there we all supported each other. Here we support sites who support people who don't care if we close.

go back and look at the minutes from the congress when that law was passed
the safe harbor provision of the DMCA was put in the law to act as balance to the new take down power of the DMCA.
Copyright holders were giving the ability to censor legitimate fair use like Parody/Commentary etc with a takedown request.
The safe harbor provision was designed to balance that with an immunity for the host.

You’re talking about a guy that’s basically saying… I used to buy (on occasion), but the only reason I used to buy is because I could never get anything free that was worth a damn. Now thanks to tubes, I don’t have to buy ever again.
This guy shouldn’t be your ideal target buyer to begin with. He’s most likely not looking for anything special (just something free), which makes him a poor choice for a potential customer. He may be a fan of a particular niche (he may like big tits for example) but he doesn’t necessarily care whether he gets it from your site or anyone elses. Whatever site this guy lands on first that can sucker him into pulling out his wallet is the one who’s going to get the sale. And he’s most likely not going to be a repeat customer either… you get him once (if you're lucky) and then nobody gets him again for the next couple months.
The real question is what percentage of the overall market does this kind of surfer accounts for? And of equal importance is how much of YOUR overall sales is this type of surfer accounting for?

I have had the same customers signup many times for all the new sites i put out. I know this because i do data on who my customers are and where they signed up at..And he?s most likely not going to be a repeat customer either? you get him once (if you're lucky) and then nobody gets him again for the next couple months.
Now lets say a guy is smart enough to know that if he waits a few days the guys at tube8will already have my members stuff up on their site so he can save some easy money. Or maybe just do a google search and get a list of 10 tubes that have stolen content from everyone of my members sites on it.
Yesterday I have to call out www.spankwire.com.. They had every one of my sites members area videos.. Maybe like 200 of them on their site... I had to get with them and ask "what the fuck were you thinking of and take that shit down" They uploaded the stuff themselves so now their just theives.
Removeyourcontent gave me the heads up and I highly recomend using them.[Comment

From what I see, and from my experience in adult, business, and just plain out life...if a person has the choice for the exact same thing to either pay for it or get it for free, Free wins everytime.
There absolutely is a way to market using a tube site. But only if I am given the ability to decide what I want out there and what I don't want out there. And yeah, I can make sales using long clips too.
What I can't do is sell a membership to a site that has the entire members area ripped and waiting for free on a torrent site.
But I did see something very interesting today.
I was looking at how Alexa has changed the design of their site. I looked up claudia-marie.com to see how we're doing on the alexa charts. I then clicked on the "Sites Linking In" link.
And pirate bay shows as linking in! I was like: "WTF?!?!?!"
Well, what happened was that on one of our old movies from 2007 that is stolen and offered up there for free...someone had posted a link back to claudia-marie.com in the "comments" spot on the page.
Holy shit! I never thought about spamming that! But I'm thinking about it now.
