Hey webmasters, should I ask for my money back, or is it my fault?

I bought some cam software that lets my members record videos and post them on my website. It was $400 for it. $200 for the software and $200 for the install.

He installed it and theres 2 problems
    1. The audio is fast but the video is slow. So the lips are moving but dont match the words being heard
    2. it doesnt take a screen shot of the video, so when someone makes a video it just shows a blank image, no screen cap. So if I use this software I will have pages of nothing on them because this software doesnt take a screen cap. It LOOKED like it took a screen cap on the sales page, but that was just an image of the video running.

I want to ask them to uninstall it and get my money back. Do you think I have the right for this? Or do you think its my fault?

It's a tough one and there might be several solutions to this.

If he's from a decent european country there are strict rules about money back, no matter if you find bugs or not.

    1. Is the audio a software problem or could it be an external player problem? It sounds odd that the audio is out of sync with the video.

    2. If you post a link to his sales page then it's far easier to help you, but IF they have made claims (visual or text) then they should honour that. If they have tried to sell you something based on false promises then get your money back.

I know it's not much help but it's all I got

you sound fairly rational, i think if you lay it out to them like you just did here theres a good chance they give your money back / fix your problem , or give you something of equal value.

It's partially your fault for not testing the software first or figuring out what your needs are and if it supports them.. but that's not easy..

I would talk to them about the issues first. They could be easily fixed with a better server or different settings.

Charge back if they give you attitude.

I didnt even think of looking at their refund policy. I just checked and I have 10 days.

Charging back can back fire. You can end up on a blacklist and get declined when
                    trying to buy other things.

Think about it, do you want to make a sale to someone who has charged back 3
                    things in the last month?

                    I don't.

I'll ask them to fix the problems and if they dont then all ask for a refund.
if they say no then Ill charge back.
A $400 sale from a company who'se software isnt good and Ill never buy from again, hell yeah Ill charge back.

Did you address the problems to the software maker? They should try to fix it for you, at least the streaming part. If they cant fix it, they should refund it.

the part about the screen shots they said their software doesnt do a screen shot of the videos it records and that the viewer is about to watch, and that they wont have that until a future build. Instead you see a blank image on the thumbnail for the video.
They didnt tell me until after the install that it doesnt take an image.

That sounds so crappy to me. Could you imagine going to YouTube and seeing a page that was all blank images, no screen shot of the video?
                          It would ruin my site.
