RedTube is just going to claim they have no liability over what videos are uploaded to their sites. I fucking hate tube sites too, but it's going to take congress to enact a special copyright team & "traffic filtering" before copyright infringement is stopped on a large scale.
These court cases have failed on much larger instances than this. (rapidshare, piratebay, etc).
Unfortunately, lawyers will keep telling copyright holders they have a case to collect ridiculous amounts of money in legal fees.

well since it is a civil case, that absolutely can not happen.
if you mean that they will lose a judgement, that would require a fundamental shift in all of the established legal precedents, or absolute proof that redtube direct employees are uploading the videos them self.

They are legal and I really didn't get into adult to debate morality, if you can't handle it then don't promote them, but they are one of my best converting sites ever since I started promoting teen. I was more talking about how TR won't allow affiliates to just grab content and plaster it all over the place, as a result, no one promoting a TR site has any advantage over another, if the surfer wants to get paysite content, they need to pay to get it, not keep searching for it.

Quick thought.. The defense for tube sites is that they are too big to monitor and approve uploads.
So would it not be possible to spam them with tens of thousands of worthless, pointless video clips to see how they react? My guess is they're able to filter the bad videos just fine, and would do so to save their website..
Monitoring of how they *CAN* be effective at removing worthless videos could then be used in court against them, no? ie: Why can they get rid of the bad ones and not get rid of the illegal ones?Comment

Well it's not stolen see....someone bought a license to view the content via a monthly membership.
They then downloaded all of the videos, and are using redtube's servers to "back up" their files.
Other people who also have a right to view the content because they purchased a membership, can watch the copy hosted on redtube's servers.
As ridiculous as all of that sounds....it's perfectly 100% legal and that's the problem. Until that part of the law gets fixed, there really isn't fuck all copyright holders can do.
So you can piss and moan and whine about the way things are, you can even file unwinnable lawsuits to try and make yourself feel better (and your attorney richer)....or you can do what entrepreneurs do, figure out a way to make a profit in today's market.

for all the people who missed it .., rkmedia does not own redtube. It is a 3 pronged assault on the site, their advertisers, and the host. Redtube is and has been for sale, you can't sell something with pending lawsuits.
This is only one of two suits against them.

The DMCA counts for user uploaded content which we all know is not how the tubes started. If this was a real business, legal action would have been brought much sooner and the server logs would have been subpoenaed to show that most of these tube sites started with thousands of videos before a single surfer landed on the home page. If they tried to destroy those records they would have been hit with destroying evidence which is actually a worse crime.I wasn't trying to.
