    California lawmaker introduces bill to legalize marijuana

    Assemblyman Tom Ammiano, a San Francisco Democrat, introduced a bill Monday that if approved by the California Legislature would put pot on the same legal footing as alcohol. Adults over the age of 21 would be allowed to buy it, and driving under the influence of marijuana would be prohibited.

    Under Ammiano's proposal, which has been endorsed by some law enforcement officials, pot would be taxed at a rate of $50 per ounce and bring an estimated $1 billion into state coffers.

    In 1996, California became the first state to legalize medical marijuana.

              Nice thought, but as my buddy in Homeland Security has told me many times, just like in the case of medicinal pot, Fed trumps state. So they can just keep arresting people regardless of state laws.

              So he welcomes the states to pass whatever they like. Then they can come goose stepping into those states and make some newspaper, and Fox News headliner busts to justify their existence..

                              Huge progress in the last 10 years... Thanks California and thank you Emerald Triangle... Boulder's right behind you. Denver legalized up to an oz. a few years back. It will be good to see this prohibition put behind us one of these days! (I lived up in Boulder Creek, outside of Santa Cruz back in the early '90's)

                                                                                                                                          the federal law trumping state law is arguable technically only the constitution trumps state law but it is arguable of course the states could call a constitutional convention and strip the federal government of over broad powers (admittedly unlikely any time soon.)

Nevertheless, showing strong state support for the issue does weaken the federal case.

The only problem would be the people still selling it not paying taxes on it but if the stores did it right it'd probably be cheaper and more convenient than waiting in a parking lot for 20 minutes.
