    Wisc. Legislature Approves Download Tax

    MADISON, Wisc. ? Wisconsin lawmakers have approved a bill requiring a five-percent sales tax on Internet downloads including adult content. The tax goes into effect Oct. 1.
    "This is not a straightforward issue and it's going to take some time to have the system up and running," Wisconsin House Majority Leader Tom Nelson said.

    A representative with the Illinois Department of Revenue told reporters that Illinois looked into taxing the web as well, but opted out because of the difficulty of taxing businesses that don't have physical locations in the state.

    Wisconsin Gov. Jim Doyle has said that the tax ? music, E-books, greeting cards and ring tones ? will generate about $11 million over the next two years. The state is short almost $600 million for the budget ending June 30, and the next budget faces a deficit of $5.7 billion.

    A similar proposal presented two years ago did not make it out of committee.

      I can't wait to see the commerce clause challenge to that law. Interstate commerce is USUALLY the domain of the Federal government. Let's see how Wisconsin plays this off as not "impeding interstate commerce".

                                      How can they tax a company that isn't in Wisconsin? Before you answer that, what if my business is in California and California has the same law? Where do I pay the tax - In both states? So I'd have to pay in both California and Wisconsin? What if my hosting company is in Florida, and they have the same law? Do I have the pay the law there too?

                                      And isn't porn protected by free speech? You can't put undue taxes on Free Speech.

                                                  The way the state of NY forced amazon and others to collect NY state sales tax on sales is based on affiliates. They claim that since amazon (and others) have affiliates based in the state of NY, that this constitutes a "physical presence" in the state, and therefore subject to the same tax structure as a brick and mortar in the state. I think it was overstock who actually banned/terminated affiliates from the state as a way to fight it. Might have that wrong though.

                                                  not at all sure how that would apply to a non-tangible like access to a website.

                                                          IE: Wisconsin based customers downloading the shit will pay the tax to Wisconsin, and those in California will pay the tax to California.. Get it now?

                                                                          this is the government just getting the population of the US warmed up before they start taxing internet business so they can start FCC censorship on the internet. they're doing it here and there even though these legislations don't pass or get rejected, they just want to start training the minds of all the sheep to get use to the idea before they go in full force. as television signals go to digital the lines between the internet and cable or blurring and you know the US government needs to start getting in control of the Internet. it will become the medium of choice in the future.

                                                                                              It would be up the person downloading in Wisconsin to pay any tax. I surely don't have to collect it or report it to the state of Wisconsin; I'm not in Wisconsin, don't pay taxes in Wisconsin, and Wisconsin laws don't apply to me.

                                                                                              I don't see this law as having any ground. At some point it will be "Well, your interstate commerce passed through our state via the backbone of the Internet, so we have the right to tax it". It's hogwash.

                                                                                                                              Guys, Wisconsin actually has a line on their state income tax form where all good citizens voluntarily note how much they spent on goods out of state (including mail order and Internet purchases) so that they may voluntarily pay the sales tax that they did not previously have the pleasure of paying.

                                                                                                                                  I like to know where these guys get their figures. They assume people will still download at the same rate. For example my state has a 8.25% sale tax on food Kentucky has ZERO % sales tax on food. Guess where people that live near the border with Kentucky go shopping for groceries? That's right Kentucky. How much money are Tennessee business losing because TN residents are shopping in KY? How much business tax revenue is the state losing because of this?

                                                                                                                                  Seriously what is stopping someone from wisconsin from asking a friend that lives in another state to download songs from itunes or whatever then sending them to him so they don't have to pay sales tax? States are like the media companies, they need to learn that the old ways won't work anymore and they need to find new ways to bring in revenue.

                                                                                                                                      The way the state of NY forced amazon and others to collect NY state sales tax on sales is based on affiliates. They claim that since amazon (and others) have affiliates based in the state of NY, that this constitutes a "physical presence" in the state, and therefore subject to the same tax structure as a brick and mortar in the state. I think it was overstock who actually banned/terminated affiliates from the state as a way to fight it. Might have that wrong though.

And now NY has even more people not getting any income and more people needs assitance. REAL fucking smart. the only way these state will elarn is for thse companies to not only can affiliates in those states but to simply stop people from that state from shopping there. Then put a page up for those people telling them why. I can 100% guarantee when nobody in a state can shop online anywhere then politicans will rethink this internet sales tax crap.
