yes, $50 replacement.
so no worries on either side.
but we did get into a drunken discussion about the matter, since person A does assume responsibilty for where she puts her blackberry. if she chooses to put it on a bar table, she incurs all responibilty for damages and releases her drunken party, including peron B, from any liability other than buying a round of shots.

You put electronics on a bar table then it's your own damn fault.
Sounds like the OP was thinking about taking a friend to small claims court or something. Take the sim card out, put it in another phone, and don't flash your phone (especially something lame like a blackberry) around any more - keep it in your pocket. Nobody has been impressed with phones since 1996.Comment

Depends where the table's at. If it's at a bar/club it's your own fault.Comment

Phones don't belong on public tables where drinks are served. You park it there at your own risk.
It is a normal hazard for spills on a table. It is also bad form to put electronics on a table.Comment

Its probably like 8 years since someone spilled a drink at a table I've been at. Ill risk it. lolComment

If I spilled beer in someone's phone I'd buy em a new one and I would expect the same.
I have caused much wreckage through drnken clumsiness and have always made amends. The end.ICQ 1454 81 522 |

Person B is not responsible because person A was a fucking idiot and put his phone in a place he/she knew could get fucked up. So now it becomes everyone's responsibility to watch out for the person A's blackberry and person A. is left out of it all because he/she should not have to watch their own shit? Person B is not required to replace the blackberry, but to be a nice friend person b can pitch in half to help person A get a new one.
Person B is not required or responsible to get person A a new one. What if it was stolen off the table? Who is person A gonna blame for his/her stupidities? Unless person B spilled the drink on the blackberry intentionally he/she is NOT responsible. As I said, offering to pay half for a replacement should be sufficient and person A should be happy with that.ICQ: 16544251 - Skype: gator37 @ eastlink.ca - email: yngwie @ isys.caComment

Have a reliance for that?
First question, but then it just changes to who pays the deductible.
Absolutely.
Better be person b
If spiller is drunk, then should accept responsibility, but even more reason to not leave it on the table.
Contributory negligence.Comment

I was poring myself a shot of Patron and a tiny bit splattered on my one day old BB... it ate holes in the screen where it hit... so now I have 3 spots on the screen about the size of a pin head. Yes... I was drunk. We were in a hotel room too... I didn't get it replaced... I just use the fucker as a reminder... don't drink Patron again... it can eat holes in a fucking cellphone screen... :DComment

I agree I can see if its in someones house or your own home but in a bar. You put it down your problem. You put electronics on a bar table then it's your own damn fault.

If you're ever partying with a bunch of people who, like you, are drinking - then you put your phone right out on a table, you're asking for drunken mistakes to befall the phone.
I say person A. If it was a sober environment, then person B.Comment

If it was in the US, then it's the bar owner. You should sue them for allowing such a thing to happen in their establishment under their supervision.
If it's anywhere else in the world, you both feel guilty as hell and argue over how you couldn't possibly let the other person pay for it.Comment
