If I remember the original contract, you did sign a contract that renewed every year and did not cancel it according to the contract so the company have every right to demand the money, the only issue is if they waited to long to ask for the money which I doubt. So I think you would lose if you try to fight it.
You did a lot to promote them but that were with a previous owner and the new owner probably don't care about this. If I had to advise you offer them a $2,000 payment you pay right away to settle the issue. If they don't accept it agree to the $3,000 paying $1,000 a month.
Don't even start pursuing the issue with not signing with your legal name it might get you into trouble.Truth TellerComment

You would have paid your lawyer to make 1 phone call and have his secretary type up 1 letter and you could have forgotten about this a long time ago.
You didn't sign the contracts with a court recognized name. You can force the collection agency to PROVE that you actually owe any money. Going to be difficult.
How does a 1 year contract turn into a 3 year contract? If the contract never ends how do they decide what is early?

I settled..
I always knew I would.
I just signed the settlement and sent it off. First payment next week.
As for taking this public, no regrets.
They fucked with me. I do what I do I fucked with them back. Sure I didnt have to I could have kept quiet. But why? For 3k Im going to at least have some words about it.
My job was to tell the public about them, they paid me for this. Now they are taking the money back so im doing the same.
Brad sorry if this ruffled your panties bud.
I always knew I would settle with them, but I was going to go down swinging and I wasnt about to let this go UNKNOWN to the public.
The same public whom I promoted this company to. Dont think of me as a disgruntled employee, im not. I am a customer. I can speak my mind.
I may be seen here now as a puss for the settlement or even a fool for talking about this publically. Either way I feel fine about the choice. I knew I was gunna pay. Either at the steps of the court or in some settlement. Im pretty proud of myself. Handled this all on my own. Broght the price down on my own and closed this issue on my own, and got the steam back on my own.
If i lost some friends here like brad in so doing oh well.
Im paying them, this issue is done.

Its fine. Im done. I probably did take this a bit further than I should have publically. But It comes to an end now. It was a good time to end it. The dollar amount to put this behind me was just what I was looking for.
Odd, but I consider it a win. Ive had worse gambling losses on my blazers in a day.

Really? Alerting fellow webmasters about fine prints they may not be aware of should be encouraged... This is an industry full of bros and alot of us are too trusting, naive or nonchalant and this is an eye opener... Sometimes you deal with say (exemple) 10 content providers over the years... All have been upfront, open and dealt with you with integrity.. then you deal with an 11th content provider.. you glance over the contract rapidly without any worries and bam, this is when you miss a line and get screwed...Last edited by xxxdesign-net; 01-28-2009, 11:15 AM.Comment

On a serious note Brad is a passionate guy that has some pretty strict principles, maybe stubborn. But its a good thing.

Fake name or not...you put pen to paper and a service was delivered. That goes for the company name as well.
If I sign "Mayor McCheese" on a contract.....and the service is provided...its still "my" signature, no matter whos name I write

If the money isn't a big deal to you then I'd say fuck it. Just pay it and be done with it. They could go broke a week after you pay and you kick yourself in the ass or they could get bought out and then harass you again.
The contract is kind of a shitty deal if it renewed each year, but what can yoiu do it was done. At least if you pay it, you won't have to deal with it ever again.In November, you can vote for America's next president or its first dictator.Comment
