    Medical MJ not legal in california?

    Lake Tahoe federal bust.. .

    SOUTH LAKE TAHOE, California - Federal agents have raided a medical marijuana dispensary at South Lake Tahoe.Five agents from the U.S. Drug Enforcement Agency were joined by local and federal authorities when they served a search warrant Thursday on Patient to Patient Collective.

    DEA Special Agent Gordon Taylor says agents seized between five and 10 pounds of processed marijuana and a small amount of U.S. currency from the dispensary.

    Taylor declined to release additional details on the raid, saying the dispensary is part of an ongoing investigation.

    No arrests were reported.

    Physician-approved marijuana use for medical purposes has been declared legal in California since voters passed Proposition 215 in 1996.

    In 2003, the Legislature provided additional legal guidance to medical marijuana users and led to dispensaries opening in California.

    Federal law makes marijuana use and sales illegal?even for medical reasons.

          Vast majority of California medical marijuana users with written prescriptions are not covered anyways which is sort of funny in a special way. Technically they need to register with a county office and get a state issued medical use card, not some co-op issued clinic card. However most people skip this step, nor bother to renew it each year.
          Another small point, there is no protection nor law that allows people to sell marijuana to patients, even at no profit. The state just never finished what the law required of them when the proposition was passed and the voters never called them on it, which handles the dispensing of the marijuana.

            State law does not supersede federal law.


            The federal law says pot is not legal.


            That is that!!! all because some states say its legal on the state level doesn't make it legal on the federal level. we are governed my state and federal laws. You me must obey both.


            Most Californians dont get that.

                      ps...since the gov is hurting so badly for cash they really should just let it be legal in states that approve so they can bring in tax money...and they can still keep dea employed to rob and resell in the states that dont...if you believe in that theory ;)

                          Yep. I was shoved thru the legal system and had to do some jail time for growing for a few patients. Even though I had all the docs. OC is a bitch on that shit.

                          Usin a bit here and there is passible but. The feds dont like the big grow ops.

                          It's basically stealing from the US because theres no taxes being paid on the weed.

                          If there were a way we can pay some taxes on the yield that would be great.

                            yeah i like to hide shit in those edits sometimes glad you caught it ;)...still dont like saying to tax it but the vast majority of people dont get licenses for legit reasons so i say just tax it...those that do need it for legit and verifiable reasons should be able to get insurance or government breaks...there are plenty of other worse drugs they could and should spend more time on searching for and incarcerating those people to offset any loses from the wacky weed...

                                Classifying it as a legal drug does doesn't mean that they have to tag it a medicinal thing. Why wouldn't it be on the same level as beer or smokes which they tax and tax here in NYS?

                                            I would have to argue with #2..there is enough crime to keep our police busy without busting drug users just for having and/or selling drugs(obviously the users create enough crime just doing stupid shit because they are fucked up and/or they lives are ruined because of it...so they resort to dumbassery---yes that's a word)..they could make sooo much more money by making it a government product..the benefits would be huge. There would be no shortage of police,programs, or anything else needed...plus we would have the added bonus of all that drug money(that would also be taken away from gangs)

People who use it for medicinal purposes and wish to actually be legal within the state must file with a county office. The charges vary by county but are typically around 150-160 per year (half if someone is on medi-cal) plus a filing fee of approx 15.00 - this fee is per year. It also should not be confused with whatever fee someone is paying some doctor for a script.

                                                  yeah i know about the cards and registration fees...i'm talking a tax per sale, like you buy a $50 eighth and after it's rung up with tax it comes to $55 for example...or the feds could just toss on their own registration fees like counties do..but they would make alot more with the per purchase tax...and of course being the gov they would end up charging registration fees and then charging tax per sale...but at least it would be totally legal at the federal level finally...

                                                    Assume they had sales tax of lets say 8% That would be like 4 bucks per 50 eighth. So to equal the 160 it would be 40 purchases worth. If someone used say an eighth per week, that is like around 10 months worth of taxes.

                                                    Sure some would use more, others less but it comes out roughly the same - assuming people pay the fee's in the first place. Problem is most do not.

                                                    It would not effect those that grow for themselves though and well that is the real rub. Most everyone I know just grows now. Those that do not just have someone that does for them for next to no money. Aside from property theft, there really is no risk in growing small amounts for personal consumption.

                                                      the people that don't pay the fee's and dont have proper documentation that get caught rolling dirty can be charged and sent to jail or pay fines so that part won't change anything from current laws and they profit...not to mention the ones that have someone that is licensed go to the clubs and purchase them stuff which turns the 40 purchases into 60+...then there are the people that arent smart enough or are too lazy to grow and would rather just go to clubs for variety and convenience...then there are the large growers that grow for the clubs that can be taxed when they sell their bulk lots to the club...as for property crimes don't tell the guy around the corner from me that got shot over 3 immature plants there is no risk
