Obama flubbed nothing - the Chief Justice of the US Supreme Court did and how sad is that he couldn't even perform a sworn oath thing without screwing up .............. are you thinking what i'm thinking Pinky? it was intentional!

No, the oath is *not* legally meaningless, even if it is a ritual. Art. II Sec 1. Cl. 8 of the US Const. clearly states that ?Before he enter on the Execution of his Office, he shall take the following oath. . . ? Therefore, from 12:00 noon until about 12:01 pm today, the President of the USA was Condoleeza Rice. From 12:01 until about 12:03 pm the President of the USA was Joe Biden. Interestingly, this means that, technically, Obama was *not* the first African-American President! (And yes, I actually am a constitutional law professor!).

Oh c'mon, what difference does it make? Obama screwed up too by jumping in early...and it's weird that neither guy had the thing memorized....but anyways.....

As soon as it happened I had visions in my head of Spacedog, Stickygreen, iMind, and their ilk all going apeshit talking about how Obama isn't really the President because of that....therefore it's setting up the NAU or the Amero or the New World Order or whatever the fuck the conspiracy flavor of the week is.

Since the ratification of the Twentieth Amendment, the oath is completely symbolic. The transition happens automatically.

"Section 1: The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin."

It was actually Supreme Court Chief Justice John Roberts that screwed up the oath...

Here is the oath, as spelled out in Article II, Section 1 of the U.S. Constitution:

"I do solemnly swear that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

Listen to what Roberts said:

First, he talked over Obama, so that Obama had to repeat the first line, and then Roberts incorrectly stated:

that I will execute the office of President TO the United States faithfully

You can see Obama pause in the video, momentarily flustered, because as a Professor of Constitutional Law for many years, I'm sure that he realized that Roberts slipped up. I'm sure he didn't want to interrupt to point out to the Chief Justice that he had flubbed the oath.

There were other mistakes by Roberts as well, but by that time, I'm sure both men just wanted to get though with it.

If he needs to take the oath of office again, I'm sure he will - Constitutional crisis settled, now let Obama get busy with his Cabinet to solve the major problems created and leftover by the Bush Administration.

I don't think he fucked up personally but you should consider that one is a Chief Justice and the other was a Constitutional lawyer about to be President. Consider the line is a part of a document which is the founding basis of our laws and country it shouldn't have happened either way.

With that said. That's nothing compared to whats to come.

Well, it appears that the right wing nutjobs have one less issue to harp about tonight:

WASHINGTON ? Chief Justice John Roberts has administered the presidential oath of office to Barack Obama for a second time, just to be on the safe side.

The unusual step came after Roberts flubbed the oath a bit on Tuesday, causing Obama to repeat the wording differently than as prescribed in the Constitution.

White House counsel Greg Craig said Obama took the oath from Roberts again out of an "abundance of caution."

The chief justice and the president handled the matter privately in the Map Room on Wednesday night.

It might make some wonder if Roberts' fuck up could have had anything to do with Obama voting against Roberts' confirmation as the Chief Justice?
