    spain supreme court rules linking to torrents is legal

    looks like the fight against torrent sites in EU just got a lot harder

    finally starting to get closer to the accurate bases in the law. Linking to the torrents is now legal, setup the fair use right to use torrents as a back up technology and then seeding would also be legal.

    From that point record/movie/tv show companies will have to find and sue only those people who are downloading the content without having purchased a right to view some time in the past.

      4. this post changes the law so that pretty much any request to a spanish hosted site would be such a bogus request.

                    sweden is part of the EU
                    the pirate bay is being attacked in sweden

                    this is the first precedent regarding the legality of linking to torrent files
                    which means it can be referenced by the pirate bay

                    the pirate bay serves torrents to the world including the US.

                        it obvious you don't understand me at all, i am nash capitalist. I object to people claiming monopoly rights for fair use. I want as much competition as possible in the fair use distribution of content. I want as many technologies as possible to compete with each other in the fair use rights of backup/recovery/timeshifting.

                        I want the cheapest, most effective, least problematic technology to win. That not anarchy that a free market.


                        Your the one who claims that 99% of people using torrents are using them to steal content they never purchased in the first place, when even the RIA own study said more than 50% of all torrent traffic is tv shows (like heroes, lost and other shows airing on broadcast tv).

                        Steve is the one who argued that the DMCA would be re-written to eliminate the safe harbor "loophole" dispite the fact there are 3 bills currently being proposed that would scale back the power of copyright holders because the DMCA went to far.

                        The courts keep pushing the line back (this example, lenz vs universal, 20th century vs cablevision) and supporting fair use.

                        Yet steve "captain caveman" jones keeps complaining about tube sites, and torrent sites instead of adapting.

                          From reading your posts it seems like your real agenda despite what you say above is for no one to have to pay for any form of entertainment that could potentially be downloaded online. After all why should they pay if free copies of nearly everything are ubiquitous and they can simply invoke fair use rights if challenged?
