the name TUBE is just making us all miserable...
Hey TarPy, hows the full length porn tubes working for ya?

OK.... but, as has been noted by many, many attorneys, including this one:Safe Harbour is the law.
Many would argue that 18 is too young to be making porn, yet we follow the law.
Many would argue that porn is immoral, period, yet we follow the law.
Many would argue that making 18 year olds look like 15 year olds through clothing and props is immoral, yet we follow the law.
"Before a web site owner can be eligible to claim the protection of the safe harbor provision of Section 512(c)(1) the DMCA, the owner must have:
1. Filed an appropriate notice with the United States Copyright Office designating the owner's agent to receive notices of claimed infringement; and
2. Displayed on the web site on a page accessible to the public, the information set forth in the notice filed with the United States Copyright Office."
And....
"To be eligible to claim the protection of the safe harbor, you must file: (i) an appropriate notice with the United States Copyright Office designating the web site owner's agent to receive notices of claimed copyright infringement, and (ii) display on your web site on a page accessible to the public, the information set forth in the notice filed with the United States Copyright Office. If you have not taken these two steps before receiving a notice of copyright infringement arising from a user's conduct, you will not be protected from liability under the safe harbor defense provisions of the Digital Millennium Copyright Act."
So, in other words, operating a tube site, or any manner of user-submitted content site, without taking the required steps FIRST.... possibly not the smartest move.
You are quite right, the law is the law -- but the WHOLE law is the law (until or unless a court says otherwise and enjoins enforcement of portions of the law) not just the parts of it that you like.

The point I'm trying to make though, is that the DMCA is actually part of the problem. I think it needs to completely be overhauled, and once that's done, then illegal tubes will be much less of a problem.
On another note, long fucking time man. You back with Top Bucks again??.Comment

I couldn't agree with you more, btw -- DMCA simply isn't up to the task of protecting both the rights of content creators/copyright owners and the fair use rights of users in its current form, and the court cases that are most on-point are progressing very slowly. I can't really blame people for trying to exploit the statute's shortcomings... but it does get tiresome watching the piracy spread nearly unabated while we await (possibly in vain) changes/improvements to the law.Q. Isn't safe harbor to protect site owners against user submitted content. Everyone knows that these illegal tube sites started by the owners themselves uploading all the videos.jim (at) amateursconvert . com Amateurs ConvertComment

his last post really punctuated my original point that "damn kids these days...", it is like they truly don't see anything morally wrong with stealing people's content

That was just used to simplify this discussion. Server logs and user info could be subpoenaed and would show people affiliated with the tube sites did most of the uploading. If those records have been destroyed, it would be just as incriminating.

Well i will put my 2 cents in here OK yeah full length stolen vids suck if they are stolen for no monetary gain on your part. but if you look on the big tubes and look into who alot of the submitters are you will see there are alot of SPONS programs that are subbing their vids every single DAY . Why to hurt their biz? NO to do some advertising to over 6 million visitors a day with WATERMARK ADVERTISING. So instead of bitching and saying hey my content is on there BE SMART get with the tube site owners and start subbing yer vids yourself get your name exposed to the masses. Then you will never have to bitch about any site pulling the tubes embeds because in the long run you will get your name out there for FREE.
FACT is tubes aren't going away anytime soon. Why do you think most of yer sponsors arent suiing them? because they see the potential to get their sites and girls out there. and they really enjoy the free advertising.
SO use them and exploit their free traffic to the most and if a site like CH or PH pulls their embeds you will thank them for extra exposure and the free trafficComment

They are not suing because it can cost a fuckload of cash while the tube site owners are often hiding offshore behind other companies. Not to mention a great deal of copyright holders never bothered to file for an actual copyright so real damages can not be collected. Aside from a select few, most are not enjoying the free advertising that comes with places giving away full scenes that are watermarked with another URL and surrounded by other non related advertisements.Comment

So Naughty America needs the tubes to rip their entire members area because nobody has ever heard of them?Well i will put my 2 cents in here OK yeah full length stolen vids suck if they are stolen for no monetary gain on your part. but if you look on the big tubes and look into who alot of the submitters are you will see there are alot of SPONS programs that are subbing their vids every single DAY . Sorry, but I don't think so...it's killing their sales. My sales on claudia-marie.com started going down. Until I did something about it. Our entire members area was up on tubes and torrents as well. Guess what? We didn't need all that fantastic advertising.
I pretty much took care of it to the best of my ability by hiring removeyourcontent.com and moving all my stuff to encrypted streaming...and guess what?
Now that I DO NOT have that great and fantastic free advertising of tube sites and torrents ripping my entire members area and giving it away for free...My sales are blowing up!
Maybe if those tubes and torrents had asked me if I needed them to post my members area for millions of teenage boys to see along with the rest of the world...I would have had the opportunity to say "No thanks"
I have more than enough ability to brand my site. As do companies that have been in business for over a decade and don't need the "help" of a goddamn thief ripping their members area, giving it away for free, and getting a check for a pre-paid spot each month from a dating site.

Absolutely. You didn't word it quite like that so I misunderstood you. And yeah...we are all doing that. But it's hard to get it to work while the full rips are still out there. But hell yeah, everybody is doing that now. It's smart.
And it would be making bank too, except for the fact that the "bad" ones are doing what they do. If this were 4 years ago and I had the technology to run my tube site http://tube.grampland.com/ I would be making killer sales, and the traffic would have been immense. Now? It ain't shit. I can put up all those tens of thousands of clips trying to sell a membership to a site that is fully ripped on an illegal tube. That is our conundrum.-Robbie

In Canada, for instance, ISPs CAN'T give you that information. Breach of privacy. In return, we pay a "piracy" tax on all blank recordable media.
That's just one example of where you'd run in to trouble in the first world. Now imagine third world countries.

If that works then fine... A lot of our stuff is on there and I have reported it.
But what's the idea of even accepting any videoclip more than a few minutes in length?
You don't have to be Einstein to figure out that 99.99% of uploaded clips longer than 5 or 6 minutes are going to be copy-righted.Comment

No, unfortunately I'm not gonna be in Amsterdam this year. I'm moving to Las Vegas that week. And I'll be in the middle of moving my family, all my belongings, 4 cars, and two big German Shepards 2,122 miles west.
I'm going to The Atlanta Forum and then flying out on the 21st to Vegas to close on the house on the 22nd then fly back and start packing. So I'll be moving for the next 5 to ten days after that.
I'm hating that I won't make it because last year was one of the best shows I've ever been to in terms of having a lot of fun and making a lot of money.
But I wouild be glad to sit down with anybody in this business in Atlanta and show them my stats. And show them what I have done to help stop my content from being given away for free while making money for people running this kind of bullshit while they make money off of others hard work.
Anyone that wants to meet up with me and walk upstairs to my suite in Atlanta I will show you what I have and what I'm doing. I don't bullshit around.
But I'm sure gonna miss out on going to Amsterdam.

no, I do not see the difference between posting pirated content on a site to show my buddies, and making a large site. they are both equally wrong. It's not "stealing" from redtube it's "stealing" from whomever owns the content.
You want to embed a video on yer blog to show yer buddies fine.. but when you run a site with 4000 videos collecting all of the stolen content from all of the illegal tubes on the net it becomes a problem..
now, for the sake of argument, lets assume that you are not implying that ALL of redtubes content is illegal.
How do I, as a web developer, differentiate between the pirated videos and the one that have been uploaded legally?
look dude, How can i be moral about something of which I have no clue on how it works?
It's not like I downloaded something from the scene. If redtube is pirating everyone's content, why has it not been shut down yet?
I'm also not a kid. I'm 29 and have been coding for 18 years. I lightly take offence to that
